An Act to amend the State Services Act 1962
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the State Services Amendment Act 1981, and shall be read together with and deemed part of the State Services Act 1962 (hereinafter referred to as the principal Act).
2 Classification and Grading Committees
Section 46 of the principal Act (as amended by section 83(1) of the State Services Conditions of Employment Act 1977 and by section 3 of the State Services Amendment Act 1978) is hereby amended by inserting, after subsection (3), the following subsections:
“(3a)
In the event of the incapacity of the Chairman or of any member of a Committee by reason of illness or absence, or any other cause, the Commission may in the manner prescribed in subsection (2) of this section, appoint some other person qualified for appointment to that office to act in the place of the Chairman or member. Every person so appointed shall, while the incapacity continues, be deemed for all purposes to be the Chairman or member of the Committee, as the case may require.
“(3b)
No appointment of a deputy and no acts done by him as such, and no acts done by the Committee while any deputy is acting as such, shall in any proceedings be questioned on the ground that the occasion for his appointment had not arisen or had ceased.”
This Act is administered in the State Services Commission.
