An Act to amend the Airport Authorities Act 1966

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Airport Authorities Amendment Act 1982, and shall be read together with and deemed part of the Airport Authorities Act 1966 (hereinafter referred to as the principal Act).

2 Bylaws

Section 9 of the principal Act is hereby amended by inserting, after subsection (4), the following subsection:

“(4a)

Any bylaw made under paragraph (e) or paragraph (g) of subsection (1) of this section shall, for the purposes of sections 42, 42a, and 43 of the Transport Act 1962, be deemed to have been made under the authority of section 72 of that Act.”

3 Consequential amendments

(1)

Section 2(1) of the Transport Act 1962 is hereby amended by adding to the definition of the term “enforcement authority” (as inserted by section 2(2) of the Transport Amendment Act 1980) the following paragraph:

“(c)

The airport authority, in the case of an alleged infringement offence detected by an officer of an airport authority.”

Section 42a of the Transport Act 1962 (as substituted by section 7 of the Transport Amendment Act 1980) is hereby amended by inserting, after subsection (1), the following subsection:

“(1a)

For the purposes of any proceedings in respect of an infringement offence that is an offence against a bylaw made under paragraph (e) or paragraph (g) of section 9(1) of the Airport Authorities Act 1966, the expressions ‘traffic officer’ and ‘officer’ include traffic officers and officers respectively appointed by an airport authority.”

Section 43 of the Transport Act 1962 (as substituted by section 7 of the Transport Amendment Act 1980) is hereby amended by adding the following subsection:

“(5)

For the purposes of this section the expression ‘local authority’ includes an airport authority.”

This Act is administered in the Ministry of Transport.
