An Act to amend the Coal Mines Act 1979

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Coal Mines Amendment Act 1982, and shall be read together with and deemed part of the Coal Mines Act 1979 (hereinafter referred to as the principal Act).

2 Cancellation of and transitional provisions relating to existing coal mining rights

Section 31(4) of the principal Act is hereby amended, as from its commencement, by adding to the proviso the words “or any disposal or dealing on or in consequence of the death of the holder of any such existing coal mining right”.

3 Coal Mining Industries Welfare Fund

(1)

Section 234(1) of the principal Act is hereby amended by repealing paragraphs (a), (b), and (c), and substituting the following paragraphs:

“(a)

A sum equivalent to 8 cents per tonne or part of a tonne on all marketable coal (other than peat mined for horticultural purposes) raised from the coal mine as a contribution towards Welfare Fund services; and

“(b)

Where a coal mine is situated within an area for the time being defined under section 236(5) of this Act in respect of a rescue station, a sum equivalent to 14.5 cents per tonne or part of a tonne on all marketable coal (other than peat used for horticultural purposes) raised from the coal mine as a contribution towards rescue station services:”.

(2)

Section 234 of the principal Act is hereby consequentially amended—

(a)

By repealing the second proviso to subsection (1):

(b)

By omitting from subsection (2) the words “(including lignite and peat)”:

(c)

By repealing subsection (7).

(3)

The Coal Mines (Coal Mining Industries Welfare Fund Levy) Order 1981 is hereby revoked.

(4)

This section shall come into force on the 1st day of July 1983.

This Act is administered in the Ministry of Energy.
