An Act to amend the Electricity Act 1968

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Electricity Amendment Act 1982, and shall be read together with and deemed part of the Electricity Act 1968 (hereinafter referred to as the principal Act).

2 Licence to supply electricity

Section 20 of the principal Act is hereby amended by adding the following subsection:

“(6)

Notwithstanding that any person who or body which has applied for a licence under this section has not been issued with the licence, all actions of that person or body taken before the 1st day of April 1983 as if that person or body had been issued with such licence are hereby validated and declared to be lawful.”

3 Temporary licence to supply electricity

The principal Act is hereby further amended by inserting, after section 20 (as amended by section 2 of this Act), the following section:

“20a

“(1)

Where the Minister is of the opinion that it is not possible for any reason to issue a licence to any person or body under section 20 of this Act, he may issue to that person or body a temporary licence under this section on such terms as he thinks fit, and subsections (1) and (4) of section 20 of this Act shall, with any necessary modifications, apply to the temporary licence in the same manner as they apply to a licence issued under the said section 20.

“(2)

Every temporary licence issued under subsection (1) of this section shall be for a fixed period ending with the 31st day of March 1985 or the earlier issue of a licence under section 20 of this Act.”

This Act is administered in the Ministry of Energy.
