An Act to amend the Sale of Liquor Act 1962

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Sale of Liquor Amendment Act 1982, and shall be read together with and deemed part of the Sale of Liquor Act 1962 (hereinafter referred to as the principal Act).

2 Corrections of principal Act

(1)

Section 66 of the principal Act (as substituted by section 15(1) of the Sale of Liquor Amendment Act 1980) is hereby amended by omitting the words “airport, or club”, and substituting the words “or airport”.

(2)

Section 69(3) of the principal Act is hereby amended by omitting the words “or general ancillary” (as inserted by section 53(2) of the Sale of Liquor Amendment Act 1976), and substituting the words “or club”.

(3)

Section 112d of the principal Act (as inserted by section 4 of the Sale of Liquor Amendment Act 1970) is hereby amended—

(a)

By omitting from paragraph (a) the word “restaurant”, and substituting the words “food and entertainment”:

By repealing paragraphs (b) and (c):

(c)

By omitting from paragraph (d) the word “restaurant” where it first occurs, and substituting the word “premises”:

(d)

By omitting from that paragraph the words “the second and third references in that paragraph to the restaurant”, and substituting the words “all other references in that paragraph to the premises”.

Sections 112m to 112o of the principal Act (as inserted by section 26(2) of the Sale of Liquor Amendment Act 1976), and the heading immediately preceding those sections (as so inserted), are hereby repealed.

Section 117a of the principal Act (as inserted by section 7 of the Sale of Liquor Amendment Act 1980) is hereby amended by omitting the words “an ancillary”, and substituting the words “a food and entertainment”.

Section 131 of the principal Act is hereby amended by repealing subsection (1), and substituting the following subsection:

“(1)

Objections to the transfer of the licence may be made by any person of or over the age of 18 years who is resident in the licensing district in which the licensed premises are situated or, in the case of licensed premises situated in a licensing trust district or suburban Trust area, who is resident in that district or area.”

Section 134b of the principal Act (as inserted by section 6(1) of the Sale of Liquor Amendment Act 1970) is hereby amended by repealing subsection (2)(b).

(8)

Section 157c of the principal Act (as inserted by section 6 of the Sale of Liquor Amendment Act 1965) is hereby amended by omitting from subsection (8) the word “restaurant”, and substituting the words “food and entertainment”.

(9)

Section 169(1) of the principal Act is hereby amended by inserting, after the expression “259,”, the expression “259a,”.

(10)

Section 176(1) of the principal Act is hereby amended by repealing paragraph (d) (as added by section 24(2) of the Sale of Liquor Amendment Act 1976).

(11)

Section 248 of the principal Act is hereby amended by inserting, after subsection (1), the following subsection:

“(1a)

Nothing in paragraph (b) or paragraph (c) of subsection (1) of this section shall apply to any game of chance or prize competition or lottery within the meaning of the Gaming and Lotteries Act 1977.”

(12)

Section 299(1)(i) of the principal Act is hereby repealed.

(13)

The following enactments are hereby consequentially repealed:

(a)

Section 26(2), subsections (2) and (3) of section 30, and section 53(2), of the Sale of Liquor Amendment Act 1976, and so much of the First Schedule to that Act as relates to section 131(1) of the principal Act:

Section 21(4) of the Licensing Trusts Amendment Act 1976:

(c)

Section 10 of the Sale of Liquor Amendment Act 1977.
