An Act to amend the Shipping and Seamen Act 1952
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Shipping and Seamen Amendment Act 1982, and shall be read together with and deemed part of the Shipping and Seamen Act 1952 (hereinafter referred to as the principal Act).
2 Interpretation
(1)
Section 2(1) of the principal Act is hereby amended by omitting the definition of the term “Safety Convention”
(as substituted by section 3 of the Shipping and Seamen Amendment Act 1965), and substituting the following definition:
“‘Safety Convention’—
“(a)
On and after the date of the entry into force in respect of New Zealand of the International Convention for the Safety of Life at Sea, done at London on the 1st day of November 1974 (that date of entry into force being referred to hereafter in this definition as the operative date), means that Convention; and includes—
“(i)
The Annex to that Convention; and
“(ii)
All amendments of that Convention in force at the operative date; and
“(iii)
All amendments of that Convention made after the operative date and in force with respect to New Zealand; and
“(iv)
The Protocol to that Convention, adopted in 1978; and
“(v)
Any further protocols to that Convention adopted after the operative date:
“(b)
Until the operative date, means the International Convention for the Safety of Life at Sea, done at London on the 17th day of June 1960, including the Regulations annexed to it:”.
(2)
Section 3 of the Shipping and Seamen Amendment Act 1965 is hereby repealed.
3 Rules and regulations may be made for 1974 Convention before it is in force
The principal Act is hereby amended by inserting, after section 504, the following section:
“504a
“(1)
In this section the term ‘operative date’ means the date on which the International Convention on the Safety of Life at Sea, done at London on the 1st day of November 1974, enters into force with respect to New Zealand.
“(2)
Without limiting any other provision of this Act, and without limiting the general power to make rules and regulations conferred by section 504 of this Act, at any time before the operative date all such rules and regulations may be made under that section, in respect of any matter to which this Act applies, as may be necessary or expedient for the purpose of implementing the said Convention as from the operative date.
“(3)
No such rules or regulations shall come into force before the operative date.”
This Act is administered in the Ministry of Transport.
