An Act to amend the Social Welfare (Transitional Provisions) Act 1990
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Social Welfare (Transitional Provisons) Amendment Act 1990, and shall be read together with and deemed part of the Social Welfare (Transitional Provisions) Act 1990 (hereinafter referred to as the principal Act).
2 Entitlement to veteran’s pension
(1)
Section 8(3) of the principal Act is hereby amended by repealing paragraph (b), and substituting the following:
“(b)
Was at any time before the 1st day of April 1990 in receipt of national superannuation—
unless he or she—
“(c)
Becomes qualified to receive a pension under Part II, Part IV, or Part V of the War Pensions Act 1954 at a rate of not less than 70 percent of the maximum rate of pension that would be payable in respect of total disablement after the date on which he or she became entitled to receive guaranteed retirement income; or
“(d)
Had elected to receive national superannuation under section 66m of the War Pensions Act 1954 (as inserted by section 4 of the War Pensions Amendment Act 1986) and either—
“(i)
Before the 1st day of April 1990, sent a written request to the Secretary to forgo national superannuation and to receive instead a war service pension; or
“(ii)
On or after the 1st day of April 1990, sent or sends a written request to the Secretary to forgo guaranteed retirement income and to receive instead a veteran’s pension.”
(2)
This section shall be deemed to have come into force on the 1st day of April 1990.
3 Payments overseas of guaranteed retirement income and veteran’s pension
(1)
Section 17(1) of the principal Act is hereby amended by inserting, after the words “gross rate of guaranteed retirement income and veteran’s pension”
, the words “(excluding any living alone payment)”
.
(2)
This section shall come into force on the 26th day of September 1990.
4 Living alone payments
(1)
The principal Act is hereby amended by inserting, after section 18, the following section:
“18a
(1)
Any unmarried person who is in receipt of guaranteed retirement income or a veteran’s pension and who is living alone in his or her principal place of residence shall be entitled to receive a living alone payment.
“(2)
The living alone payment shall be the amount specified in clause 3 of the First Schedule to this Act.
“(3)
For the purposes of this section, a person shall be considered to be living alone if he or she occupies a principal place of residence that is—
“(a)
A house or flat; or
“(b)
A hotel room, motel unit, a room in a licensed boardinghouse, or a unit of accommodation in a caravan park—
and does not share that residence or household expenses (including accommodation expenses) with any person of or over the age of 18 years other than—
“(c)
A dependent child of or over that age; or
“(d)
A temporary visitor who stays less than 13 weeks in any period of 26 weeks.”
(2)
This section shall come into force on the 26th day of September 1990.
5 Amending First Schedule
(1)
The First Schedule to the principal Act is hereby amended by adding the following clause:
“3
Living alone payment $1,040 a year ($20 a week).”
(2)
This section shall come into force on the 26th day of September 1990.
