An Act to amend the Transport (Vehicle and Driver Registration and Licensing) Act 1986

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title and commencement

(1) This Act may be cited as the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1997, and is part of the Transport (Vehicle and Driver Registration and Licensing) Act 1986 (“the principal Act”).

(2) Except as provided in sections 3(4) and 9(3), this Act comes into force on the day on which it receives the Royal assent.

2 Interpretation

(1) This subsection substituted the definition of the term Registrar in s 2(1) of the principal Act.

(2) This subsection consequentially amended Schedule 3 to the State-Owned Enterprises Act 1986.

3 Motor vehicles to be registered and licensed

(1) Section 5 of the principal Act is amended by repealing subsections (1A) and (1B), and substituting the following subsection:
- “(1A) Once a motor vehicle is registered in accordance with this Part then, except as otherwise provided in this Act or in regulations made under section 35A(1)(a),—
  
  “(a) The owner of the vehicle must keep the vehicle licensed at all times under this Part; and
  
  “(b) The fees payable in respect of such licensing are payable as if the vehicle is at all times required to be licensed (whether or not it is actually licensed).”
(2) Section 5 of the principal Act is amended by repealing subsection (6).

(3) Section 3 of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992 is consequentially amended by repealing subsections (1) and (4).

(4) This section comes into force on a date to be appointed by the Governor-General by Order in Council.

4 Issue of registration plates and certificates of registration

(1) This subsection amended s 8(1) of the principal Act.

(2) This subsection inserted s 8(6) of the principal Act.

5 Issue and display of licences

(1) This subsection amended s 13(1) of the principal Act.

(2) This subsection inserted s 13(6) of the principal Act.

6 Replacement certificates of registration, licences, and registration plates

This section amended s 15(3) of the principal Act.

7 Notification of change of ownership of motor vehicle

(1) This subsection amended s 20(1) of the principal Act.

(2) This subsection repealed s 20(2) of the principal Act.

(3) Section 13 of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992 is consequentially repealed.

(4) The Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992 is amended by repealing section 14(2).

8 Particulars required to be supplied by persons acquiring ownership

This section amended s 22(1) of the principal Act.

9 Cancellation of registration where licence for motor vehicle not renewed

(1) This subsection substituted s 28(3) of the principal Act.

(2) Section 18 of the Transport (Vehicle and Driver Registration and Licensing) Amendment Act 1992 is consequentially repealed.

(3) This section comes into force on a date to be appointed by the Governor-General by Order in Council.

10 Issue of trade plates and trade licences

(1) This subsection amended s 34(1) of the principal Act.

(2) This subsection inserted s 34(2) of the principal Act.

11 Regulations

This section substituted s 35A of the principal Act.

12 Exemption, waiver, or discount for fees or charges relating to supply of information from register

This section inserted s 36A of the principal Act.

13 Delegation of Secretary's functions or powers to persons outside Ministry

This section inserted s 51A(8) of the principal Act.
