An Act to amend The Protection of Personal and Property Rights Act 1988

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title

This Act may be cited as the Protection of Personal and Property Rights amendment Act 1997, and is part of The Protection of Personal and Property Rights Act 1988 (the principal Act).

2 Order to administer property

This section substituted s 11(2) of the principal Act.

3 Application to trustee corporation in respect of small estates

Section 33(1) of the principal Act is amended by inserting, after the expression “$100,000”, the words “or such other amount as is, from time to time, prescribed by Order in Council for the purposes of this subsection”.

(2) Section 33(7) of the principal Act is amended by inserting, after the expression “$120,000”, the words “or such other amount as is, from time to time, prescribed by Order in Council for the purposes of this subsection”.

4 First 1 amended

Clause 3 of Schedule 1 of the principal Act is amended by omitting the words “may be prescribed”, and substituting the words “is, from time to time, prescribed by Order in Council for the purposes of this clause”.

5 Schedule 2 amended

Clause 2 of Schedule 2 of the principal Act is amended by omitting the words “may be prescribed”, and substituting the words “is, from time to time, prescribed by Order in Council for the purposes of this clause”.
