The Parliament of New Zealand enacts as follows:
1 Title
(1)
This Act is the Dairy Industry Amendment Act (No 2) 2000.
(2)
In this Act, the Dairy Industry Act 1952 is called “the principal Act”
.
2 Commencement
This Act is deemed to have come into force on 12 October 1990.
3 Milk not to be sold if tainted or impure
Section 16(b) of the principal Act is amended by omitting the words “, or that has calved within 4 clear days before the day on which the milk was so drawn”
.
4 New section 16A inserted
The principal Act is amended by inserting, after section 16, the following section:
“16A Sale or supply of colostrum to dairy permitted if nature of milk clearly stated in writing
“(1)
A person must not sell or supply to a dairy milk given by, or milk containing milk given by, a milking animal within 4 days after giving birth, unless the nature of the milk is clearly stated, in writing, at the time of the sale or supply.
“(2)
In subsection (1), milking animal means a cow, ewe, or goat, kept for milking.”
5 Dairy Industry Regulations 1990 consequentially amended
Regulation 40 of the Dairy Industry Regulations 1990 is amended by—
(a)
revoking paragraph (c); and
(b)
omitting the words “period of time since giving birth,”
.
