The Parliament of New Zealand enacts as follows:
1 Title
(1)
This Act is the Dietitians Amendment Act 2001.
(2)
In this Act, the Dietitians Act 1950 is called “the principal Act”
.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 Functions of Board
(1)
Section 8 of the principal Act is amended by repealing paragraph (d), and substituting the following paragraph:
“(d)
to ensure that examinations are conducted under this Act by—
“(i)
conducting those examinations itself; or
“(ii)
arranging to have those examinations conducted on its behalf; or
“(iii)
arranging to have some of the functions involved in conducting those examinations performed on its behalf, and performing the rest itself:”.
(2)
Section 8 of the principal Act is amended by adding, as subsection (2), the following subsection:
“(2)
For the purposes of subsection (1)(d), conducting examinations includes the following functions:
“(a)
appointing examiners; and
“(b)
making all necessary arrangements for the purposes of the examinations; and
“(c)
issuing certificates to persons who have passed the examinations.”
4 Regulations
(1)
Section 32(2)(c) of the principal Act is amended by inserting, after the word “by”
, the words “, on behalf of, or partly by and partly on behalf of,”
.
(2)
Section 32(3)(a) of the principal Act is amended by inserting, after the words “conducted by”
, the words “, or partly by and partly on behalf of,”
.
5 Validation of dietitians’ qualifications previously obtained
(1)
This section applies to a person who has passed an examination conducted—
(a)
for the purposes of the principal Act; and
(b)
before the enactment of sections 3 and 4 of this Act; and
(c)
wholly or partly by someone other than the Board on its behalf, but otherwise in accordance with the principal Act.
(2)
A person to whom this section applies must be treated for all purposes as if he or she had passed an examination conducted by the Board in accordance with the principal Act.
(3)
Subsection (2) is for the avoidance of doubt.
