Contents
The Parliament of New Zealand enacts as follows:
1 Title
-
(1) This Act is the Retirement Villages Amendment Act 2005.
(2) In this Act, the Retirement Villages Act 2003 is called
“the principal Act”
.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 Retirement villages to be registered
Section 10(3)(b) of the principal Act is amended by omitting the expression
“subsection (1)”
, and substituting the expression“subsection (2)”
.
4 Annual return
5 Occupation right agreement voidable
6 Time for giving dispute notice
Section 57(1) of the principal Act is amended by omitting the word
“complaint”
, and substituting the words“dispute notice given”
.
7 Panel may refuse to hear dispute
Section 66 of the principal Act is amended by adding the following subsection:
“(7) Any person against whom costs are awarded under this section must pay them within 28 days of the decision to award them.”
8 Schedule 4 amended

(1) Schedule 4 of the principal Act is amended by repealing paragraph (c) under the heading
“Other contact persons”
.(2) Schedule 4 of the principal Act is amended by adding the following heading and note:
Information The Retirement Commissioner publishes information on the code of residents' rights and disputes procedures available under the Retirement Villages Act 2003 that may assist to resolve your complaint.
