The Parliament of New Zealand enacts as follows:
1 Title
-
(1) This Act is the Copyright Amendment Act 2005.
(2) In this Act, the Copyright Act 1994 is called
“the principal Act”
.
2 Commencement
This Act comes into force on the day on which it receives the Royal assent.
3 No copyright in certain works
Section 27 of the principal Act is amended by inserting, after subsection (1), the following subsections:

“(1A) No Crown copyright exists in any work, whenever that work was made,—
“(a) in which the Crown copyright has not been assigned to another person; and
“(b) that is incorporated by reference in a work referred to in subsection (1).
“(1B) Except as specified in subsection (1A), nothing in subsection (1) affects copyright in any work that is incorporated by reference in a work referred to in subsection (1).”
