The Parliament of New Zealand enacts as follows:
1 Title
-
(1) This Act is the Armed Forces Discipline Amendment Act 2005.
(2) In this Act, the Armed Forces Discipline Act 1971 is called
“the principal Act”
.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 Interpretation
-
(1) Section 2(1) of the principal Act is amended by repealing paragraph (c)(iii) of the definition of commanding officer, and substituting the following subparagraph:
“(iii) a ship declared by the Chief of Defence Force, the Chief of Navy, the Chief of Army, or the Chief of Air Force to be a service ship:”.
(2) Section 2(1) of the principal Act is amended by omitting from paragraph (a)(iii) of the definition of superior commander the words
“the Chief of Naval Staff, the Chief of General Staff, or the Chief of Air Staff”
, and substituting the words“the Chief of Navy, the Chief of Army, or the Chief of Air Force”
.
4 Authority to convene courts-martial
Section 119 of the principal Act is amended by omitting the words
“the Chief of Naval Staff, the Chief of General Staff, or the Chief of Air Staff”
wherever they occur, and substituting in each case the words“the Chief of Navy, the Chief of Army, or the Chief of Air Force”
.
5 Constitution of reviewing authorities
Section 151(1)(b) of the principal Act is amended by—
(a) omitting from subparagraph (i) the words
“Chief of Naval Staff”
, and substituting the words“Chief of Navy”
; and
(b) omitting from subparagraph (ii) the words
“Chief of General Staff”
, and substituting the words“Chief of Army”
; and
(c) omitting from subparagraph (iii) the words
“Chief of Air Staff”
, and substituting the words“Chief of Air Force”
.
