The Parliament of New Zealand enacts as follows:
1 Title
-
(1) This Act is the Terrorism Suppression Amendment Act 2005.
(2) In this Act, the Terrorism Suppression Act 2002 is called
“the principal Act”
.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
Part 1
Amendments to principal Act
3 Interpretation
Paragraph (a) of the definition of financing of terrorism in section 4(1) of the principal Act is amended by omitting the expression
“section 8(1)”
, and substituting the expression“section 8(1) or (2A)”
.
4 Financing of terrorism
Section 8 of the principal Act is amended by inserting, after subsection (2), the following subsection:
“(2A) A person commits an offence who, directly or indirectly, wilfully and without lawful justification or reasonable excuse, provides or collects funds intending that they benefit, or knowing that they will benefit, an entity that the person knows is an entity that carries out, or participates in the carrying out of, 1 or more terrorist acts.”

Extension of existing designations under section 22 of principal Act

6 Extension of certain designations under principal Act

Consequential amendments

7 Amendment to Immigration Act 1987
Section 2(1) of the Immigration Act 1987 is amended by omitting from paragraph (d) of the definition of act of terrorism the expression
“section 8(1)”
, and substituting the expression“section 8(1) or (2A)”
.
8 Amendment to Proceeds of Crime Act 1991
Section 2(1) of the Proceeds of Crime Act 1991 is amended by omitting from paragraphs (c) and (d) of the definition of tainted property the expression
“section 8(1)”
in both places where it appears, and substituting in each case the expression“section 8(1) or (2A)”
.
