The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Citizens Initiated Referenda Amendment Act 2012.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 Principal Act amended
This Act amends the Citizens Initiated Referenda Act 1993.
4 Writ for indicative referendum conducted by postal voting
Section 26A is amended by repealing subsection (6) and substituting the following subsection:
“(6) The latest day for the return of the writ is the 60th day after the issue of the writ.”
5 Endorsement and return of writ

(1) Section 39 is amended by inserting the following subsections after subsection (5):
“(5A) If the voting period for an indicative referendum conducted by postal voting is extended under section 37 of the Referenda (Postal Voting) Act 2000, the Electoral Commission may postpone the return of the writ until as soon as practicable after noon on the fourth day after the last day of the extended voting period.
“(5B) Subsection (5A) applies whether the voting period is extended in relation to the whole or any area or areas of New Zealand, or any or all of Tokelau, Campbell Island, Raoul Island, or the Ross Dependency.”
(2) Section 39(6) is amended by omitting
“and (5)”
and substituting“to (5B)”
