The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Contractual Remedies Amendment Act 2016.
2 Commencement
This Act comes into force on 1 March 2017.
3 Principal Act
This Act amends the Contractual Remedies Act 1979 (the principal Act).
4 New section 4A inserted (Stipulations not essence of contracts)
After section 4, insert:
4A Stipulations not essence of contracts
Stipulations in contracts as to time or otherwise that would not, before 13 September 1882 (the date of the coming into force of the Law Amendment Act 1882), have been deemed to be or to have become the essence of such contracts in a court of equity must receive in all courts the same construction and effect as they would have received in equity before that date.
