Proposed amendment
Hon Andrew Little, in Committee, to move the following amendment:
Clause 2
After clause 2(2) (page 3, after line 10), insert:

An Order in Council made under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
Explanatory note
This Supplementary Order Paper amends clause 2 of the Mental Health (Compulsory Assessment and Treatment) Amendment Bill to provide that an Order in Council made under that clause to commence the Bill, once the Bill is enacted, is secondary legislation. This will ensure that, after the commencement of the Legislation Act 2019 on 28 October 2021, that Order in Council will be subject to the publication, presentation, and disallowance provisions of that Act rather than the current Legislation Act 2012. The Legislation Act 2012 is repealed on 28 October 2021 by section 10 of the Legislation (Repeals and Amendments) Act 2019 (see the Legislation (Repeals and Amendments) Act Commencement Order 2021).
