Proposed amendment
Hilary Calvert, in Committee, to move the following amendment:
Clause 27
To add the following subclause (after line 35 on page 31):
(5) To avoid doubt, neither a customary marine title group nor an applicant group is entitled to charge or collect fees or other form of payment from any person or body for the use or occupation of any part of the common marine and coastal area.
Explanatory note
This Supplementary Order Paper amends the Marine and Coastal Area (Takutai Moana) Bill to ensure that no individual or group may be charged for access to the common marine and coastal area. It is based on the similar prohibition on charging contained in the existing Foreshore and Seabed Act, which draws a distinction between an “individual” and a “body”. The Supplementary Order Paper proposed by the Attorney-General does not do this, and mentions only the “individual”.
