Sentencing (Aggravating Factors) Amendment Bill
Proposed amendments
Charles Chauvel, in Committee, to move the following amendments:
Clause 4
In clause 4, replace “definition in its appropriate alphabetical order”
(lines 2 and 3 on page 2) with “definitions in their appropriate alphabetical order”
.
In clause 4, before definition of prison officer (line 4 on page 2), insert:
“emergency first responder means any of the following persons who, in the particular circumstances of the case, are lawfully required to assist at the scene of an accident or an emergency:
“(a) any ambulance officer, medic, or paramedic, whether or not he or she is registered as a health practitioner; and
“(b) any health practitioner; and
“(c) any member of a fire brigade within the meaning of the Fire Service Act 1975
“health practitioner has the same meaning as in section 5 of the Health Practitioners Competence Assurance Act 2003”
Clause 5
In clause 5, new section 9(1)(fa), after “constable”
(line 9 on page 2), insert “, or an emergency first responder”
.
Explanatory note
This Supplementary Order Paper would amend the Sentencing (Aggravating Factors) Amendment Bill to clarify that assaults on health professionals required by law to provide assistance at the scene of an accident or emergency, or on members of a fire brigade carrying out their duties, are of no less gravity than assaults on police or prison officers carrying out their duties.
