Proposed amendments
David Seymour, in Committee, to move the following amendments:
Clause 4
In clause 4, after the definition of Minister of the Crown (page 2, after line 4), insert as subclauses (2), (3), and (4):
(2)
In section 2(1), definition of official information, after paragraph (a)(ii), insert:
(iia)
a judge or judicial officer with responsibility for judicial determination of any legal proceedings; or
(iib)
an organisation providing administrative support to a judge or judicial officer referred to in subparagraph (iia); or
(3)
In section 2(1), definition of official information, replace paragraph (i) with:
(i)
does not include information contained in any correspondence or communication which has taken place with the office of the Ombudsman and which relates to an investigation conducted by an Ombudsman under this Act or under the Ombudsmen Act 1975, other than information that came into existence before the commencement of that investigation; and
(4)
In section 2(1), definition of official information, after paragraph (l), insert:
(m)
includes information of an administrative or financial nature held by a judge or a judicial officer, or any organisation providing administrative support to a judge or judicial officer, but does not include information relating to the judicial determination of any legal proceedings held by such persons; and
(n)
does not include information contained in any correspondence or communication which has taken place with the office of the Controller and Auditor-General and which relates to the performance of a function, duty, or power of the Controller and Auditor-General under the Public Audit Act 2001
New clause 5
After clause 4 (page 2, after line 4), insert:

In Schedule 1, insert in their appropriate alphabetical order:
Controller and Auditor-General
Ombudsmen
Explanatory note
This Supplementary Order Paper applies the Official Information Act 1982 to the following parliamentary and judicial officers:
Controller and Auditor-General, but not in relation to information held relating to the exercise of their functions and powers under the Public Audit Act 2001:
Ombudsmen, but not in relation to information held relating to investigations under the Ombudsmen Act 1975 and the Official Information Act 1982:
administrative and financial information held by District Court Judges:
administrative and financial information held by Judges of the High Court:
administrative and financial information held by Judicial officers with responsibility for judicial determination of proceedings:
administrative and financial information held by organisations providing administrative support to judges and judicial officers.
