Proposed amendments
Hon Nanaia Mahuta, in Committee, to move the following amendments:
Clause 27A
In clause 27A(1), replace “1 November 2041 (which is the expiry of 25 years”
(page 22, lines 3 and 4) with “1 November 2026 (which is the expiry of 10 years”
.
In clause 27A(3), after paragraph (a) (page 22, after line 10), insert:
(aa)
the effect of the Kermadec/Rangitāhua Ocean Sanctuary on Māori customary and commercial rights; and
Explanatory note
This Supplementary Order Paper amends clause 27A, which provides for a review of the operation of the Bill. The Bill does not adequately protect the “full and final” rights established in the Treaty of Waitangi (Fisheries Claims) Settlement Act 1992, in particular those fishing rights relating to Fishery Management Area 10. The amendments to clause 27A are intended to change the proposed review period to 10 years, and will make provision for the consideration of the effect of the Kermadec/Rangitāhua Ocean Sanctuary on Māori customary and commercial rights.
