Proposed amendments to SOP No 279
Marama Davidson, in Committee, to move the following amendments:
New clause 496A
After clause 496 (page 320), insert:
496A Section 16 amended (Empowering acquisition of land)
After section 16(2), insert:
(3)
Subsections (1) and (2) do not apply to Māori land as defined in section 5 of Parts 1 to 9 of Te Ture Whenua Māori Act 2016, except by agreement.
New clause 497A
After clause 497 (page 320), insert:
497A Section 17 amended (Acquisition by agreement)
Repeal section 17(4) and (5).
Explanatory note
This Supplementary Order Paper amends Supplementary Order Paper No 279, which amends Te Ture Whenua Māori Bill, to exempt Māori land from the Crown’s ability to acquire it for the purposes of public works, either by agreement or confiscation. The number one priority of any Māori land reform should be to protect the small amount of land that remains in Māori ownership from further loss and alienation. This issue was raised at select committee by many submitters, yet the Bill as reported has failed to address it. This Supplementary Order Paper remedies that.
