Proposed amendment
Nicola Willis, in Committee, to move the following amendment:
Clause 18
In clause 18, new clause 12A(2), in paragraph (b), replace “.”
(page 8, line 18) with “; or”
, and after paragraph (b), insert:
(c)
the principal or the board considers the employee to be wholly unsuitable for appointment, due to the character of the school.
Explanatory note
This Supplementary Order Paper amends the Education Amendment Bill.
Every principal of a New Zealand school has the discretion and ability to recruit and employ their own staff. The transitional arrangements in this Bill remove that ability from the principals of partnership schools kura hourua transitioning to specified State schools, and compel them to offer an equivalent position to an employee without discretion. This amendment allows these principals to exercise discretion in employing staff, and removes the obligation on them to hire an employee who may be unfit or unsuitable to the special character of the school.
