Proposed amendment
Hon Tim Macindoe, in Committee, to move the following amendment:
New clause 7
After clause 6 (page 4, after line 18), insert:
7 New section 71BA (Obligation to provide copy of member expulsion rules)
After section 71B, insert:
71BA Obligation to provide copy of member expulsion rules
(1)
Any political party registered under this Act must ensure the party has rules governing the process by which a party leader can expel a member of Parliament under sections 55AAB to 55E.
(2)
The secretary of any political party registered under this Act must supply the Electoral Commission with a copy of the rules referred to in subsection (1).
(3)
The copy required by subsection (2) must be supplied within 1 month after notice of the registration of the party is notified in the Gazette in accordance with section 67(1)(c).
(4)
The copy required by subsection (2) must be supplied within 1 month after the date on which the changes to the rules are adopted by the party.
(5)
Members of the public are entitled to inspect the documents supplied to the Electoral Commission under this section, without payment, at any time between 9 am and 5 pm on any day on which the office of the Electoral Commission is open.
Explanatory note
This Supplementary Order Paper amends the Electoral (Integrity) Amendment Bill. It inserts new clause 7 to ensure there is an explicit provision in the Electoral Act 1993 that requires parties to (a) formulate rules around expulsion of members of Parliament, and (b) provide those rules to the Electoral Commission.
