Proposed amendment
Karen Chhour, in Committee, to move the following amendment:
New Clause 43AA
After Clause 43 (page 20, after line 4) insert new Clause 43AA:
43AA Section 134A amended (Status of penalties under section 134)

In section 134A(b), delete “(except the purposes of Part 9)”.
(2)
In section 134A, insert as subsection (2):

For the avoidance of doubt, a penalty payable under section 134 must be treated as of the same nature as the amount in respect of which it was imposed for the purposes of Part 9.
Explanatory note
This Supplementary Order Paper would require penalties paid to the Crown as a result of the late or non-payment of child support to be transferred by the Crown to the carer who should have received the child support.
