Proposed amendments
Hon Mark Mitchell, in Committee, to move the following amendments:
Clause 1
In clause 1, replace “First Responders and Prison Officers”
(page 2, line 1) with “Constables, Corrections Officers, and First Responders”
.
Clause 4
In the heading to clause 4, replace “first responder or prison officer”
(page 2, line 10), with “constable, corrections officer, or first responder”
.
In the heading to new section 189A, replace “first responder or prison officer”
(page 2, line 13), with “constable, corrections officer, or first responder”
.
In new section 189A(1)(a) and (b), replace “first responder or prison officer”
(page 2, lines 15 and 18), with “constable, corrections officer, or first responder”
in each place.
In new section 189A(1)(b), replace “being reckless as to whether their conduct may lead to that result,”
(page 2, line 17), with “with reckless disregard for the safety of others,”
.
In new section 189A, replace subsection (2) (page 2, lines 20 to 28) with:

In this section—
constable has the same meaning as in section 4 of the Policing Act 2008
corrections officer—
(a)
means an officer within the meaning of section 3(1) of the Corrections Act 2004; and
(b)
includes a security officer within the meaning of that section
first responder means an emergency services worker within the meaning of section 92(4) of the Health and Safety at Work Act 2015.
Clause 8
Replace clause 8 (page 3, lines 18 to 27) with:

In the heading to section 10, replace “Police, prison”
with “constable, corrections officer, first responder”

In section 10, replace “constable, or any prison officer, or any”
with “constable, corrections officer, first responder, or”

In section 10, insert as subsection (2):

In this section—

Explanatory note
This Supplementary Order Paper proposes changes to terminology used in the Protection for First Responders and Prison Officers Bill to ensure that it aligns with existing legislation.
