Clause 4
In clause 4, delete subclause (2) (page 6, line 15).
Clause 5
Delete clause 5 (page 7, lines 28 and 29).
Clause 55
Delete clause 55 (page 37, lines 33 and 34).
Clause 59
In clause 59, after subclause (1) (page 38, after line 21), insert:

In Schedule 1, Part 4, after clause 87, insert:
Review of approval process for early childhood education services
87A Review of approval process for early childhood education services
(1)
The Minister must ensure that a review is undertaken of the approval process for early childhood education services set out in sections 17 to 18C to evaluate whether that process has been successful, including whether it has had any adverse effect on the number of new services being established.
(2)
The review undertaken under subclause (1) must—
(a)
commence no sooner than 1 August 2025; and
(b)
be provided to the Minister no later than 1 August 2027.
(3)
The Minister must, within 20 working days of the day the review is provided to the Minister under subclause (2)(b), present the review to the House of Representatives.
Schedule 1
In Schedule 1, new Part 6 of Schedule 1, delete subpart 1 (page 42, line 6 to page 43, line 3).
Schedule 4
In Schedule 4, Part 2, delete the item relating to the Education (Early Childhood Services) Regulations 2008 (SR 2008/204) (page 52, lines 15 to 25).
Explanatory note
This Amendment Paper amends the Education and Training Amendment Bill. The network management approval process was introduced only in 2023 and there has not been sufficient time to evaluate whether it has been successful or not. Data from 2023 suggests that the process has not had any adverse effect on the number of new services established—in fact, there was an increase from 2022. This Amendment Paper removes the repeal of the network management approval process on this basis. However, it also provides for a review of the network management approval process to be undertaken when sufficient data can be collected over multiple years.
