Present:
Her Excellency the Governor-General in Council
These rules are made under section 228 of the District Court Act 2016—
(a)
on the advice and with the consent of the Executive Council; and
(b)
with the concurrence of the Chief District Court Judge and at least 2 other members of the Rules Committee continued under section 155 of the Senior Courts Act 2016 (of whom at least 1 was a District Court Judge).
Rules
1 Title
These rules are the District Court Amendment Rules 2026.
2 Commencement
These rules come into force on 1 May 2026.
3 Principal rules
These rules amend the District Court Rules 2014.
4 Schedule 5 amended
(1)
In Schedule 5, Part 1, item 1, replace “1,270”
with “1,750”
.
(2)
In Schedule 5, Part 1, item 2, replace “1,910”
with “2,650”
.
(3)
In Schedule 5, Part 1, item 3, replace “2,820”
with “3,900”
.

Explanatory note
This note is not part of the rules but is intended to indicate their general effect.
These rules, which come into force on 1 May 2026, amend Schedule 5 of the District Court Rules 2014 to increase the appropriate daily recovery rates for costs of represented parties in the District Court.
The daily recovery rates are increased by approximately 37.8% to reflect the increase in the Producers Price Index for legal services since 2019, when the rates were last updated.
