This order is made under section 53 of the Trade in Endangered Species Act 1989 on the advice and with the consent of the Executive Council.

1 Title
This order is the Trade in Endangered Species Order 2023.
2 Commencement
3 Principal Act
This order amends the Trade in Endangered Species Act 1989.
4 Schedules 1, 2, and 3 replaced
Replace Schedules 1, 2, and 3 with the Schedules 1, 2, and 3 set out in the Schedule of this order.

The countries listed in the column headed “Exceptions/limitations and countries requiring export permit”
are parties to the Convention that require an export permit to authorise trade in the species listed in this schedule. Trade in those species in relation to other countries that are party to the Convention requires a certificate of origin.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order updates the schedules of the Trade in Endangered Species Act 1989 that list endangered, threatened, and exploited species. The changes align the schedules with changes that have been made to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (the Convention).
Most of the changes come into force on 13 July 2023. Clause 5, which amends Schedules 1 and 2, comes into force on 25 November 2023. Clause 6, which amends Schedule 2, comes into force on 25 May 2024. Clause 7, which amends Schedules 2 and 3, comes into force on 25 November 2024. The timing of these changes depends on when the related changes to the Convention take effect.
