The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Hamilton City Council (Parana Park) Land Vesting Act 2011.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 Interpretation
In this Act, unless the context otherwise requires,—
Council means the Hamilton City Council
the land means the land commonly known as Parana Park—
(a) comprising more or less 1.2141 hectares; and
(b) described in computer freehold register SA128/41.
4 Purpose
The purpose of this Act is to—
(a) repeal the Hamilton City (Parana Park) Empowering Act 1958; and
(b) vest the land in the Council as a recreation reserve under the Reserves Act 1977; and
(c) provide for related matters.
Vesting of land in Council and related matters
5 Land freed of trusts, etc, and vested in Council

(1) The land is no longer subject to the trusts of the last will and testament of George Parr.
(2) The land is no longer subject to the provisions of the Hamilton City (Parana Park) Empowering Act 1958.
(3) The fee simple estate in the land is vested in the Council.
6 Council to hold land as recreation reserve

(1) The Reserves Act 1977 applies to the land as if the Council had—
(a) declared that the land be held for the purpose of a recreation reserve under section 14 of that Act; and
(b) notified that the reserve be known as Parana Park in accordance with section 16(10) of that Act.
(2) Accordingly, the Council has, and may exercise, in relation to the land, all the powers conferred on the Council by that Act, including those conferred on the Council in its capacity as the administering body of the land.
Miscellaneous provisions
7 Vesting of land not gift, supply of services, or disposition, for certain purposes
To avoid doubt, the vesting of the land by this Act is not—
(a) a dutiable gift for the purposes of the Estate and Gift Duties Act 1968:
(b) a supply of goods and services for the purposes of the Goods and Services Tax Act 1985:
(c) a sale, disposition, distribution, or transfer of property or liability for the purposes of the Income Tax Act 2007.
8 Powers of Registrar-General of Land

(1) The Registrar-General of Land is authorised and directed to make entries in the registers under the Land Transfer Act 1952 and to do all other things as may be necessary to give effect to the provisions of this Act.
(2) The Registrar-General must, on application,—
(a) issue a new computer register in the name of Hamilton City Council for the land; and
(b) enter on the computer register the words
“Recreation reserve subject to the Hamilton City Council (Parana Park) Land Vesting Act 2011”
.
9 Repeal of Hamilton City (Parana Park) Empowering Act 1958
The Hamilton City (Parana Park) Empowering Act 1958 (1958 No 8 (L)) is repealed.
