The Parliament of New Zealand enacts as follows:
1 Title
-
(1) This Act is the Deaths by Accidents Compensation Amendment Act 2005.
(2) In this Act, the Deaths by Accidents Compensation Act 1952 is called
“the principal Act”
.
2 Commencement
This Act comes into force on 26 April 2005.
3 Application
The amendments to the principal Act in sections 4 to 6 apply only to actions brought in respect of persons who die on or after the commencement of this Act.
4 Interpretation

(1) Section 2(1) of the principal Act is amended by omitting from the definition of dependant the words
“wife, husband,”
in both places where they appear, and substituting in each case the words“spouse, civil union partner,”
.(2) Section 2(1) of the principal Act is amended by repealing the definition of wife, and substituting the following definition:
“spouse and civil union partner includes, in relation to a deceased person, a person who—
“(a) has been the deceased person's spouse or civil union partner, as the case may be; and
“(b) at the time of the deceased person's death, was maintained or entitled to be maintained by the deceased person either wholly or partly, or would, but for the incapacity due to the accident from which the deceased person's death resulted, have been so maintained or entitled”
5 Action to be for benefit of family
Section 5 of the principal Act is amended by omitting the words
“wife or husband”
, and substituting the words“spouse or civil union partner”
.
