Social Security (Entitlement Cards) Amendment Act 2007: repealed, on 15 June 2023, pursuant to section 146 of the Births, Deaths, Marriages, and Relationships Registration Act 2021 (2021 No 57).

The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Social Security (Entitlement Cards) Amendment Act 2007.
2 Commencement
This Act comes into force on the day after the date on which this Act receives the Royal assent.
Part 1 Social Security Act 1964
3 Principal Act amended
This Part amends the Social Security Act 1964.
4 Purpose of this Part
The purpose of this Part is to provide regulation-making powers for—
(a)
cardholder photographs on entitlement cards; and
(b)
barcodes on entitlement cards; and
(c)
microchips embedded in entitlement cards.
5 Regulations providing for issue and use of entitlement cards
(1)
Section 132A(1) is amended by inserting the following paragraph after paragraph (b):
(ba)
providing for cardholders’ photographs to be affixed to or imaged into a category of entitlement cards and prescribing procedures, requirements, and other matters in relation to those photographs:

Section 132A(2) is amended by omitting “a magnetic stripe on them,”
and substituting “all or any of a magnetic stripe or a barcode on them, or a microchip embedded in them,”

(3)
Section 132A is amended by adding the following subsections:
(3)
An Order in Council providing for the embedding of microchips in entitlement cards may not be made under this section except on the recommendation of the Minister.
(4)
The Minister must not recommend the making of an Order in Council referred to in subsection (3) unless, to ensure privacy and personal information are fully protected, adequate consultation concerning the privacy and security of the information to be contained in the microchip has taken place with—
(a)
the State Services Commission; and
(b)
the Privacy Commissioner; and
(c)
any other State agency, department, or organisation the Minister considers relevant.
Part 2 Births, Deaths, and Marriages Registration Act 1995
6 Principal Act amended
This Part amends the Births, Deaths, and Marriages Registration Act 1995.
7 Purpose of this Part
The purpose of this Part is to allow the disclosure of information required to give effect to Part 1 in relation to cards the availability of which is based principally on the age and residence of a person, or of his or her spouse or civil union partner, or former spouse or civil union partner.
8 Schedule 1A amended
(1)
The item relating to the Department of Work and Income in Schedule 1A is amended by omitting “Department of Work and Income”
and substituting “Ministry of Social Development”
.
(2)
Paragraph (b) of the item relating to the Department of Work and Income in Schedule 1A is amended by adding “or a card the availability of which is based principally on the age and residence of a person, or of his or her spouse or civil union partner, or former spouse or civil union partner”
.
