An Act to amend the Tourist and Publicity Department Act 1963
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the New Zealand Tourism Department Amendment Act 1990, and shall be read together with and deemed part of the Act heretofore known as the Tourist and Publicity Department Act 1963 (hereinafter referred to as the principal Act).
2 Altering Short Titles
(1)
The principal Act may hereafter be cited as the New Zealand Tourism Department Act 1963.
(2)
The Short Title of the principal Act and the Short Title of the Tourist and Publicity Department Amendment Act 1967 and the Short Title of the Tourist and Publicity Department Amendment Act 1989 are hereby consequentially amended, in each case, by omitting the words “Tourist and Publicity”
, and substituting the words “New Zealand Tourism”
.
(3)
Every reference in any enactment to any of the said Acts is hereby consequentially amended by omitting the words “Tourist and Publicity”
, and substituting the words “New Zealand Tourism”
.
3 Altering name of Department
(1)
The principal Act is hereby further amended—
(a)
By omitting the words “Tourist and Publicity”
from the Tide, from the definitions of the term “Department”
in section 2, and from sections 3 and 15, and substituting in each case the words “New Zealand Tourism”
:
(b)
By omitting from section 3 the words “the same name”
, and substituting the words “the name of the Tourist and Publicity Department”
.
(2)
Every reference to the Tourist and Publicity Department in the First Schedule to the Ombudsmen Act 1975 and the First Schedule to the State Sector Act 1988 (as substituted by section 28(1) of the State Sector Amendment Act (No. 2) 1989) and (unless the context otherwise requires) every reference in any other enactment or document to the Tourist and Publicity Department, shall be read as a reference to the New Zealand Tourism Department.
4 General Manager
(1)
The principal Act is hereby amended by repealing section 4, and substituting the following section:
“4
The chief executive of the Department shall be known as the General Manager of the New Zealand Tourism Department.”
(2)
Section 2 of the principal Act is hereby amended by repealing the definition of the term “General Manager”
.
(3)
Every reference to the General Manager of the Tourist and Publicity Department in any other enactment or document shall, unless the context otherwise requires, be read as a reference to the General Manager of the New Zealand Tourism Department.
(4)
Every act of authority done by the General Manager of the Tourist and Publicity Department pursuant to any Act, regulation, rule, order, notice, or other authority, and subsisting at the commencement of this Act, shall continue and have effect after the commencement of this Act as if it had been done by the General Manager of the New Zealand Tourism Department.
5 Transitional provisions in respect of officers and employees
(1)
The person holding office at the commencement of this Act as General Manager of the Tourist and Publicity Department shall be deemed to have been appointed as General Manager of the New Zealand Tourism Department.
(2)
All other persons who at the commencement of this Act are officers or employees of the Tourist and Publicity Department and have been so appointed under the State Services Act 1962 or the State Sector Act 1988 shall be deemed to have been so appointed as officers or employees of the New Zealand Tourism Department.
6 Repeals
The principal Act is hereby further amended by repealing sections 5, 6, 9, 10, and 13.
7 Saving
Every delegation made under section 9 or section 10 of the principal Act and in force immediately before the commencement of this Act shall continue to have effect according to its tenor as if,—
(a)
In the case of a delegation made under section 9 of the principal Act, it had been made on the commencement of this Act under section 28 of the State Sector Act 1988; and
(b)
In the case of a delegation made under section 10 of the principal Act, it had been made on the commencement of this Act under section 41 of the State Sector Act 1988.
This Act is administered in the New Zealand Tourism Department.
