An Act to amend the Wheat Board Act 1965 to provide a new method of grading wheat, and to provide for the removal of regulatory controls on the wheat and flour industry and the eventual abolition of the New Zealand Wheat Board
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Wheat Board Amendment Act 1986, and shall be read together with and deemed part of the Wheat Board Act 1965 (hereinafter referred to as the principal Act).
2 Interpretation
[Repealed]Sections 2 to 11 and 14 were repealed, as from 1 December 1988, by section 4(4) Trade and Industry Act Repeal Act 1986 (1986 No 156).
3 Membership of Board

4 Terms of office of appointed members

11 Wheat Board to cease trading in wheat and flour
[Repealed]Sections 2 to 11 and 14 were repealed, as from 1 December 1988, by section 4(4) Trade and Industry Act Repeal Act 1986 (1986 No 156).
12 Wheat Board to wind up its operations before dissolution
(1)
Having regard to the provisions of section 13 of this Act, the Board shall do all that is necessary to ensure the orderly winding up of the operations of the Board, including—
(a)
The payment of all money owed by and the recovery of all debts due to the Board; and
(b)
The sale or disposal of all real and personal property belonging to the Board.
(2)
The winding up required by subsection (1) of this section shall be effected by the earlier of—
(a)
The close of the 31st day of January 1989; or
(3)
The Board shall cause to be prepared final accounts of the Board as at the earlier of—
(a)
The 31st day of January 1989; or
(b)
which accounts shall include inventories of all real and personal property belonging to the Board and all real and personal property sold or disposed of by the Board pursuant to subsection (1) of this section since the 31st day of January 1987.
(4)
The Board shall not sell or otherwise dispose of any real or personal property pursuant to subsection (1) of this section without the prior approval of the Minister of Commerce or of some other person authorised in writing by the Minister of Commerce for that purpose, and the proceeds from any such sale or disposition shall be paid into the Consolidated Account.
Subsection (4) was amended, as from 1 December 1988, by section 4(1) Trade and Industry Act Repeal Act 1986 (1986 No 156) by substituting the words “Minister of Commerce”
for the word “Minister”
.
13 Dissolution of Wheat Board
(1)
On the commencement of this section—
(a)
The Board shall be dissolved; and
(b)
All real and personal property belonging to the Board shall become vested in the Crown subject to all liabilities, charges, obligations, or trusts affecting that property; and
(c)
All money payable to the Board shall become payable to the Crown; and
(d)
All liabilities and obligations of any nature (other than under contracts of employment) and all rights and authorities of any nature whatever of the Board shall become liabilities, obligations, rights, and authorities of the Crown; and
(e)
All proceedings pending by or against the Board may be carried on, completed, or enforced by or against the Crown.
(2)
This section shall come into force on—
(a)
The 1st day of February 1989; or
(b)
Such earlier date as may be appointed for the commencement thereof by the Governor General by Order in Council,—
whichever occurs first.
(3)
Any Order in Council made under subsection (2) of this section shall not come into force before the expiration of 3 months after the Order in Council has been gazetted.
14 Repeals and consequential amendments
[Repealed]Sections 2 to 11 and 14 were repealed, as from 1 December 1988, by section 4(4) Trade and Industry Act Repeal Act 1986 (1986 No 156).
