The Parliament of New Zealand enacts as follows:
1 Title
-
(1) This Act is the Parental Leave and Employment Protection Amendment Act 2005.
(2) In this Act, the Parental Leave and Employment Protection Act 1987 is called
“the principal Act”
.
2 Commencement
This Act comes into force on 26 April 2005.
3 Interpretation
-
(1) Section 2(1) of the principal Act is amended by inserting, after the definition of parental leave, the following definition:
“partner, in the phrase
‘spouse or partner’
and in related contexts, means a civil union partner or a de facto partner”.(2) Section 2(1) of the principal Act is amended by repealing the definition of spouse, and substituting the following definition:
“spouse means a husband or wife.”
4 Dismissal for cause not affected
5 Overview
Section 71B(3) of the principal Act is amended by inserting, after the word
“spouses”
, the words“or partners”
.
6 Entitlement may be transferred to spouse
Section 71E(3) of the principal Act is amended by repealing paragraph (a), and substituting the following paragraph:
“(a) references in this Part to the employee's entitlement to a parental leave payment are references to the entitlement of the employee's spouse or partner to a parental leave payment; and”.
7 Joint adoptions
Section 71H(1) of the principal Act is amended by inserting, after the word
“spouses”
in both places where it appears, the words“or partners”
.
8 Amendments to principal Act in Schedule
The provisions of the principal Act specified in the Schedule are amended by inserting, after the word
“spouse”
wherever it appears, the words“or partner”
.

(1) Section 4(1)(c) of the Parental Leave and Employment Protection Amendment Act 2004 is amended by inserting, after the word
“spouse”

.(2) Section 26(1)(c) of the Parental Leave and Employment Protection Amendment Act 2004 is amended by inserting, after the word
“spouse”
, the words“or partner”
.
