Pursuant to section 59(7) of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.
Order
1 Title
This order is the Fisheries (Schedule 5) Order 2009.
2 Commencement
This order comes into force on 1 October 2009.
3 New item inserted in Schedule 5 of Fisheries Act 1996
Schedule 5 of the Fisheries Act 1996 is amended by inserting the following item in its appropriate alphabetical order:
“Redbait (Emmelichthys nitidus)”
.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 1 October 2009, amends Schedule 5 of the Fisheries Act 1996 to include redbait among the species for which quota aggregation of up to and including 45% is permitted.
Issued under the authority of the Acts and Regulations Publication Act 1989.
Date of notification in Gazette: 27 August 2009.
