New Zealand Public Health and Disability Amendment Act 2005: repealed, on 1 July 2022, pursuant to section 103(1) of the Pae Ora (Healthy Futures) Act 2022 (2022 No 30).

The Parliament of New Zealand enacts as follows:
1 Title
(1)
This Act is the New Zealand Public Health and Disability Amendment Act 2005.
(2)
In this Act, the New Zealand Public Health and Disability Act 2000 is called “the principal Act”
.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 New heading and section 57 substituted
The principal Act is amended by repealing section 57 and the heading before that section, and substituting the following heading and section:
Crown Health Financing Agency
57 CHFA
(1)
The body corporate established by section 16 of the Health Sector (Transfers) Act 1993 is continued under the name of the Crown Health Financing Agency (CHFA).
(2)
CHFA is a Crown entity for the purposes of section 7 of the Crown Entities Act 2004.
(3)
The Crown Entities Act 2004 applies to CHFA except to the extent that this Act expressly provides otherwise.
(4)
CHFA is owned by the Crown.
4 References to Residual Health Management Unit to be read as references to Crown Health Financing Agency
Unless in any case the context otherwise requires, every reference to the Residual Health Management Unit or RHMU in any enactment or document is, after the commencement of this section, to be read as a reference to the Crown Health Financing Agency or CHFA.
Schedule Consequential amendments
Part 1 Amendments to New Zealand Public Health and Disability Act 2000
Section 5(7)
Omit the words “Residual Health Management Unit (RHMU)”
and substitute the words “Crown Health Financing Agency (CHFA)”
.
Section 6(1)
Insert, after the definition of Crown funding agreement:
CHFA means the Crown Health Financing Agency continued by section 57
Omit from the definition of publicly-owned health and disability organisation the expression “RHMU”
and substitute the expression “CHFA”
.
Repeal the definition of RHMU.
Heading to section 58
Omit the expression “RHMU”
and substitute the expression “CHFA”

Omit the expression “RHMU”
in both places where it occurs and substitute in each case the expression “CHFA”

Insert in Part 1 of Schedule 1, before the item relating to District Health Boards, the following item:

Omit from Part 1 of Schedule 1 the item relating to the Residual Health Management Unit.
Health Sector (Transfers) Act 1993 (1993 No 23)
Insert in section 2(1), after the definition of Crown entity:
CHFA means the Crown Health Financing Agency continued by section 57 of the New Zealand Public Health and Disability Act 2000
Omit from the definition of publicly-owned health and disability organisation in section 2(1) the expression “RHMU”
and substitute the expression “CHFA”
.
Repeal the definition of RHMU in section 2(1).
Omit from section 13(4) the words “Residual Health Management Unit”
and substitute the words “Crown Health Financing Agency”
.
Ombudsmen Act 1975 (1975 No 9)
Omit from Part 2 of Schedule 1 the item “Residual Health Management Unit”
and substitute, in its appropriate alphabetical order, the item “Crown Health Financing Agency”
