Pursuant to section 450(3D) of the Building Act 2004, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
This order is the Building (Building Consent Authority Transition) Order 2008.
2 Commencement
This order comes into force on 26 June 2008.
3 Later date substituted for date in section 450(3)(b)(ii) of Building Act 2004
Section 450(3)(b)(ii) of the Building Act 2004 is amended by omitting
“30 June 2008”
and substituting“31 March 2009”
.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 26 June 2008, substitutes a later date for the date specified in section 450(3)(b)(ii) of the Building Act 2004 (the Act). The substituted date defers for 9 months the end (if they have not ended earlier, and there is no further deferral) of the following:
the period, specified in section 450(3) of the Act, during which a territorial authority may act as a building consent authority (including in relation to a dam) even though the territorial authority has yet to be registered under section 191 of the Act; and
the duty, under section 450(3A) of the Act, of a territorial authority that is registered under section 191 of the Act to act as a building consent authority in relation to a dam within that territorial authority's district.
