(1) This Act is the Patriotic and Canteen Funds Amendment Act 2005.

(2) In this Act, the Patriotic and Canteen Funds Act 1947 is called “the principal Act”.

This Act comes into force on the day after the date on which it receives the Royal assent.

(1) Section 2 of the principal Act is amended by repealing the definition of Board.

(2) Section 2 of the principal Act is amended by omitting from paragraph (c) of the definition of serviceman the words “on the application of the Board”.

Part 1 of the principal Act is repealed.

(1) Section 33(1) of the principal Act is amended by omitting the words “to the Board or”.

(2) Section 33(2) of the principal Act is amended by omitting the words “of the Board or”.

(3) Section 33(4) is amended by omitting the words “of the Board or”.

(1) Section 34(1) of the principal Act is amended by—

• (a) omitting the words “of the Board and” ; and

• (b) omitting the words “the Board and”.

(2) Section 34(2) of the principal Act is amended by—

• (a) omitting the words “of the Board or” in both places where they appear; and

• (b) omitting the words “of that Board or”.

(3) Section 34(4) of the principal Act is amended by omitting the words “of the Board or”.

(4) Section 34(5) of the principal Act is amended by omitting the words “Board or”.

(5) Section 34(6) of the principal Act is amended by omitting the words “Board or”.

(1) The principal Act is amended by repealing the heading to section 35, and substituting the following heading: “Additional powers of each Council: superannuation”.

(2) Section 35(1) of the principal Act is amended by—

• (a) omitting the words “The Board and each”, and substituting the word “Each” ; and

• (b) omitting the words “Board or” wherever they appear.

(3) Section 35(2) of the principal Act is repealed.

Section 36 of the principal Act is amended by omitting the words “The Board and each”, and substituting the word “Each”.

(1) The heading to section 37 of the principal Act is amended by omitting the words “of either Board or”.

(2) Section 37 of the principal Act is amended by—

• (a) omitting the words “by the Board or by any Council” wherever they appear, and substituting in each case the words “by any Council” ; and

• (b) omitting the words “of the Board or Council” wherever they appear, and substituting in each case the words “of the Council”.

(3) Section 37(4) of the principal Act is amended by—

• (a) omitting the words “of the Board or of any Council”, and substituting the words “of any Council” ; and

• (b) omitting the words “by the Board or Council” in both places where they appear, and substituting in each case the words “by the Council”.

(1) Section 38(1) of the principal Act is amended by—

• (a) omitting the words “by the Board or” ; and

• (b) omitting the words “vested in the Board or the appropriate Council”, and substituting the words “vested in the appropriate Council”.

(2) Section 38(2) of the principal Act is amended by—

• (a) omitting the words “The Board and each”, and substituting the word “Each” ; and

• (b) omitting the words “Board or” wherever they appear.

(3) Section 38(3) of the principal Act is amended by omitting the words “the Board or”.

(1) The heading to section 39 of the principal Act is amended by omitting the words “Board and”.

(2) Section 39 of the principal Act is amended by—

• (a) omitting the words “out of the Funds, to the members of the Board and” ; and

• (b) omitting the words “(as well as the members of the Board)”.

(1) Section 40(1) of the principal Act is amended by omitting the words “The Board and each”, and substituting the word “Each”.

(2) Section 40(1A) of the principal Act is amended by omitting the words “the Board or”.

(3) Section 40(2) of the principal Act is amended by omitting the words “The Board and each”, and substituting the word “Each”.

(4) Section 40(3) of the principal Act is amended by omitting the words “The Board and each Council are public entities”, and substituting the words “Each Council is a public entity”.

Section 41 of the principal Act is repealed.

(1) The heading to section 42 of the principal Act is amended by omitting the words “Canteen Board and”.

(2) Section 42(1) of the principal Act is amended by—

• (a) omitting the words “of the Board, or” ; and

• (b) omitting the words “Board or”.

(1) Section 43(1) of the principal Act is amended by—

• (a) omitting the words “The Board and each”, and substituting the word “Each” ; and

• (b) omitting from paragraph (d) the words “Board or”.

(2) Section 43(2) of the principal Act is amended by—

• (a) omitting the words “of the Board or” ; and

• (b) omitting the words “Board or”.

Section 44(1) of the principal Act is amended by omitting the words “to the Board or to any Council, and the Board or the Council”, and substituting the words “to any Council, and the Council”.

Section 46(1) of the principal Act is amended by repealing paragraph (c), and substituting the following paragraph:

(1) Section 47(1) of the principal Act is amended by—

• (a) omitting the words “the Board, or” ; and

• (b) omitting the words “of that Board or” ; and

• (c) omitting the words “of that Board, or”.

(2) Section 47(3) of the principal Act is amended by omitting the words “to the Board or”.

Section 49(1) of the principal Act is amended by—

• (a) omitting the words “in the Board or” ; and

• (b) omitting the words “, or of the Board,”.

Part 2 of Schedule 1 of the Local Authorities (Members' Interests) Act 1968 is amended by repealing the item relating to the Patriotic and Canteen Funds Board.

Part 2 of Schedule 1 of the Ombudsmen Act 1975 is amended by repealing the item relating to the Patriotic and Canteen Funds Board.

Schedule 2 of the Public Audit Act 2001 is amended by repealing the item relating to the Patriotic and Canteen Funds Board.

Section 79(1)(f) of the Stamp and Cheque Duties Act 1971 is amended by omitting the words “the Patriotic and Canteen Funds Board,”.
