The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Domestic Violence Amendment Act 2012.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 Principal Act amended
This Act amends the Domestic Violence Act 1995.
4 Interpretation
(1)
Section 124A is amended by inserting the following definition in its appropriate alphabetical order:
District Court includes a Justice or Justices, or a Community Magistrate or Community Magistrates, presiding over a District Court; but does not include a Registrar
(2)
Section 124A is amended by adding the following definition:
Registrar means any Registrar of a District Court; and includes a Deputy Registrar.
5 Contravention of Police safety order
Section 124L(1) is amended by omitting “against whom an order is issued”
and substituting “who has been served with an order”
.
6 Issue of summons where person cannot be brought before District Court within 24 hours
Section 124M(3) is amended by omitting “the District Court”
and substituting “a District Court or Registrar”
.
7 Issue of warrant to arrest person who contravenes Police safety order or fails to attend adjourned proceedings
Section 124O(2) is amended by omitting “The District Court”
and substituting “A District Court or Registrar”
.
8 Consequential amendments to Domestic Violence (General) Regulations 1996
(1)
This section amends the Domestic Violence (General) Regulations 1996.

Form 2 of the Schedule is amended by inserting “/Registrar/Deputy Registrar”
after “Community Magistrate(s)”
.

Form 5 of the Schedule is amended by inserting “/Registrar/Deputy Registrar”
after “Community Magistrate(s)”
.

Form 6 of the Schedule is amended by inserting “/Registrar/Deputy Registrar”
after “Community Magistrate(s)”
