These regulations are administered by the Ministry of Business, Innovation, and Employment.
Pursuant to sections 33(1) and 35(1)(fa) of the Energy (Fuels, Levies, and References) Act 1989, Her Excellency the Administrator of the Government makes the following regulations, acting—
(a)
on the advice and with the consent of the Executive Council; and
(b)
for regulations made under section 33(1) of that Act, on the recommendation of the Minister of Energy and Resources made in accordance with section 33(3) of that Act.
Regulations
1 Title
These regulations are the Energy (Petroleum or Engine Fuel Monitoring Levy) Regulations 2015.
2 Commencement
These regulations come into force on 23 February 2016.
Regulations: confirmed, on 17 December 2016, by section 11 of the Subordinate Legislation Confirmation Act 2016 (2016 No 103).
3 Interpretation
In these regulations, unless the context otherwise requires,—
levy means the levy payable under section 24 of the Energy (Fuels, Levies, and References) Act 1989
table means the Excise and Excise-equivalent Duties Table (as defined in section 76A of the Customs and Excise Act 1996).
4 Levy rate
The levy rate is—
(a)
0.045 cents for the period beginning on 23 February 2016 and ending on the close of 30 June 2016:

0.2 cents on or after 1 July 2016.
5 Prescribed types of petroleum or engine fuel
The levy is payable for petroleum or engine fuel that is specified in the table as a type of—
(a)
motor spirit:
(b)
diesel:
(c)
biodiesel:
(d)
ethyl alcohol under the heading Fuels in Part A or B of the table.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 23 February 2016, prescribe the rate of the petroleum or engine fuel monitoring levy and the types of petroleum or engine fuels for which the levy is payable.
There will be a transitional rate of 0.045 cents per litre during the period beginning on 23 February 2016 and ending on the close of 30 June 2016. On or after 1 July 2016, the rate will be 0.2 cents per litre.
Under section 33(4) of the Energy (Fuels, Levies, and References) Act 1989, these regulations expire on the close of 31 December 2016, unless confirmed by an Act of Parliament passed before that date.
