These regulations are administered by the Ministry of Transport.
These regulations are made under section 269A of the Land Transport Act 1998—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Transport under section 269A(1) and (2)(b) of that Act.
Regulations
1 Title
These regulations are the Land Transport (Motor Vehicle Registration and Licensing) Amendment Regulations 2016.
2 Commencement
These regulations come into force on the day after the date of their notification in the Gazette.
Regulations: confirmed, on 17 December 2016, by section 14 of the Subordinate Legislation Confirmation Act 2016 (2016 No 103).
3 Principal regulations
These regulations amend the Land Transport (Motor Vehicle Registration and Licensing) Regulations 2011 (the principal regulations).
4 New regulation 64B inserted (Additional fee for certain RUC vehicles)
Before regulation 65, insert:
64B Additional fee for certain RUC vehicles
(1)
The additional fee payable under section 269A of the Act in respect of certain classes of RUC vehicles is specified in Part 2AC of Schedule 5.
(2)
The additional fee is payable at the same time as the fee payable in respect of an application for a licence for a motor vehicle or for the issue of trade plates (as the case may be).
5 Schedule 5 amended
In Schedule 5, before Part 3, insert:

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the day after the date of their notification in the Gazette, amend the Land Transport (Motor Vehicle Registration and Licensing) Regulations 2011.
Regulation 4 inserts new regulation 64B, which prescribes the additional fee payable under section 269A of the Land Transport Act 1998 (the Act) in respect of certain classes of RUC vehicles as specified in new Part 2AC of Schedule 5. That new Part is inserted by regulation 5. Section 269A authorises the prescribing of an additional fee in respect of all or certain classes of RUC vehicles that are operated on road and are exempt from road user charges under section 38 or 38A of the Road User Charges Act 2012.
Section 270 of the Act applies to these regulations because the additional fee is, under section 269A(2)(a) of the Act, to be treated as land transport revenue for the purposes of the Land Transport Management Act 2003. These regulations are a confirmable instrument under section 47B of the Legislation Act 2012. They are revoked at the close of 30 June 2017, unless earlier confirmed by an Act of Parliament. That stated time is the applicable deadline under section 47C(1)(a) of the Legislation Act 2012.
