These regulations are administered by the Ministry of Business, Innovation, and Employment.
These regulations are made under section 201 of the Health and Safety at Work Act 2015—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Workplace Relations and Safety made after complying with section 202 of that Act.
Regulations
1 Title
These regulations are the Health and Safety at Work (Rates of Funding Levy) Regulations 2016.
2 Commencement
These regulations come into force on 4 April 2016.
3 Rate of funding levy payable by employers
For the purposes of section 201(2)(a) of the Health and Safety at Work Act 2015, the rate of the levy payable by every employer (on the amount of earnings paid or deemed to have been paid by the employer to the employer’s employees) is 8 cents per $100.
4 Rate of funding levy payable by certain earners
(1)
For the purposes of section 201(2)(b) of the Health and Safety at Work Act 2015, the rate of the levy payable by every earner who has earnings as a self-employed person (on the amount of earnings as a self-employed person derived or deemed to have been derived by the earner or, if the earner has purchased weekly compensation under section 208 of the Accident Compensation Act 2001, on the level of weekly compensation purchased) is 8 cents per $100.
(2)
For the purposes of section 201(2)(c) of the Health and Safety at Work Act 2015, the rate of levy payable by every earner who has earnings as a shareholder-employee who has purchased weekly compensation under section 190 of the Accident Compensation Act 2001 (on the level of weekly compensation purchased) is 8 cents per $100.
Regulation 4: replaced, on 1 April 2025, by section 65 of the Regulatory Systems (Immigration and Workforce) Amendment Act 2025 (2025 No 10).
5 Revocation
The Health and Safety in Employment (Rates of Funding Levy) Regulations 1994 (SR 1994/49) are revoked.

1 General
This is a consolidation of the Health and Safety at Work (Rates of Funding Levy) Regulations 2016 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
