Explanatory note
General policy statement
The Child Protection (Child Sex Offender Government Agency Registration) Amendment Bill (the Bill) amends the Child Protection (Child Sex Offender Government Agency Registration) Act 2016 (the Act).
The objective of the Bill is to improve the safety of children and young people in our community. It does this by—
improving the clarity of the Act:
enhancing the consistency of the Act to support the practice of the Child Sex Offender Register staff:
assisting registrable offenders to more easily comply with the Act and the requirements placed on them under the Act:
updating the Act to reflect evolving technology and to address legislative gaps.
The key amendments the Bill makes to the Act are to—
require registrable offenders to report that a child is going to be residing at the same address as them 48 hours before this occurs (rather than 72 hours after):
require registrable offenders to report attendance at education or training courses, and clarify that voluntary work must be reported:
clarify the definition of locality for registrable offenders with no permanent address or fixed abode in New Zealand:
enable notices to be served to registrable offenders by electronic means (rather than just by post):
require registrable offenders travelling out of the country to report this information at least 7 days in advance (rather than the current 48 hours in advance):
require registrable offenders to report their return to New Zealand no more than 72 hours after re-entering, electronically or by phone (rather than the current 10 day in-person requirement):
clarify that if there is a successful appeal against registration, that information must be removed from the Child Sex Offender Register:
remove the requirement for an application for review to be made within 28 days of registration.
The Bill adds the following 7 qualifying offences to Schedule 2 of the Act:
intentionally or recklessly making an intimate visual recording of another person (section 216H of the Crimes Act 1961), if the subject of the visual recording is under 16 years of age:
knowingly importing or exporting objectionable publications (section 390 of the Customs and Excise Act 2018), if the subject or a subject of the publication is under 16 years of age and the publication deals with sex:
causing, assisting, facilitating, or encouraging a person under 18 years of age to provide commercial sexual services to any person (section 20 of the Prostitution Reform Act 2003), if the victim is under 16 years of age:
receiving a payment if a person knows, or ought reasonably to know, that it is derived, directly or indirectly, from commercial sexual services provided by a person under 18 years of age (section 21 of the Prostitution Reform Act 2003), if the victim is under 16 years of age:
entering into a contract or arrangement under which a person under 18 years of age provides commercial sexual services (section 22(1) of the Prostitution Reform Act 2003), if the victim is under 16 years of age:
dealing in people under 18 years of age for sexual exploitation, removal of body parts, or engagement in forced labour (section 98AA of the Crimes Act 1961), if the victim is under 16 years of age and subject to sexual exploitation:
receiving commercial sexual services from a person under 18 years of age (section 22(2) of the Prostitution Reform Act 2003), if the victim is under 16 years of age.
The Bill also makes a range of other administrative amendments to the Act.

Clause by clause analysis
This Bill amends the Child Protection (Child Sex Offender Government Agency Registration) Act 2016 (the principal Act) and comes into force 3 months after Royal assent.
Part 1Amendments to Parts 1 and 2
Subpart 1—Amendments to Part 1 (preliminary matters)
Section 3 of the principal Act provides that the purpose of the principal Act is to establish a Child Sex Offender Register that will reduce sexual reoffending against child victims and the risk posed by serious child sex offenders. Clause 4 amends section 3 to clarify that 1 way in which the Act achieves its purpose is to provide government agencies with the information to manage the risk posed by, as well as monitor, child sex offenders who are living in the community.
Clauses 5 and 6 amend sections 4 and 7 of the principal Act, which define key terms used in the principal Act. Various defined terms are amended, inserted, and removed, including for the purposes of aligning terms used across legislation, updating cross-references, and clarity. Changes of note include the following:
the existing definition of registrable offender has been redrafted to aid clarity, including by specifying that a corresponding registrable offender who holds or has applied for a residence class visa and has been granted entry permission to New Zealand is a registrable offender:
a new definition of a registrable offender’s place of residence is inserted, based on section 72(3) of the Electoral Act 1993:
register information is introduced as a term in the principal Act and defined:
the definition of specified agency is relocated from section 43 (see clause 30) to section 4 of the principal Act and the following agency and officer are added to the new definition of specified agency or officer:
Oranga Tamariki—Ministry for Children:
the Registrar-General appointed under section 124(1) of the Births, Deaths, Marriages, and Relationships Registration Act 2021.
Subpart 2—Amendments to subpart 1 of Part 2 (establishment and administration of register)
Section 10 of the principal Act establishes the Child Sex Offender Register (the register). Clause 8 amends section 10 to enable the Commissioner of Police (the Commissioner) to include in the register information held by the Police that relates to monitoring, or managing the risk posed by, a registrable offender.
Clause 9 repeals section 11 of the principal Act, which is about the administration of the register. The substance of section 11 is reinserted as new section 51 (see clause 39). New sections 51 to 51C gather together the provisions in the principal Act relating to the administration of the register. Clause 7 consequentially replaces the subpart 1 heading of Part 2 of the principal Act to reflect the repeal of section 11.
Subpart 3—Amendments to subpart 2 of Part 2 (reporting obligations)
Section 16 of the principal Act lists the relevant personal information that a registrable offender is required to report. Clause 11 replaces section 16 with new section 16, which expands the list of relevant personal information that a registrable offender must report. The effect of this amendment is that a registrable offender will be required to report the following additional relevant personal information:
their email address (new section 16(1)(f)(ii)):
the details of any education or training course or programme they are attending or enrolled to attend (new section 16(1)(j)):
their nationality (new section 16(1)(l)):
the name of each country of which they are a citizen (new section 16(1)(m)):
the details of each New Zealand refugee travel document or certificate of identity they hold (new section 16(1)(o)):
the details of any internet service, computer system or device, and any other storage device, they use or intend to use (new section 16(1)(r)):
the identifying details of any computer system or device they use that is capable of enabling another computer system or device to access the internet, such as a modem or a router (new section 16(1)(r)(iii)):
the details of any username for an online account they use for a service used to obscure internet activity or direct network traffic (new section 16(1)(s)(iv)).
New section 16(1) clarifies that the relevant personal information that a registrable offender must provide is that which applies at the time they make a report. New section 16(2) requires a registrable offender to report the name of an identifiable area or location with as much specificity as possible. New section 16(3) defines computer system.
Clause 14 replaces section 18(4) of the principal Act with new section 18(4) and (5). New section 18(4) and (5) requires a registrable offender who has been in custody to report details of that custody regardless of whether their most recent report of relevant personal information was made under section 17 (initial report) or section 18 (periodic report).
Clause 15 replaces sections 20 to 23 of the principal Act with new sections 20, 20A, 20B, 20C, 21, 21A, 22, and 23 and inserts cross-headings above new sections 20 and 21.
New sections 20 to 20C specify a registrable offender’s reporting obligations if there is a change to relevant personal information they have already reported (see new section 16).
New section 20 requires a registrable offender to report anticipated changes to the following information at least 48 hours before the change occurs:
their place of residence (as required by new section 16(1)(e)):
details of any child who resides in the same place of residence and of the child’s principal caregiver (as required by new section 16(1)(g)).
The requirement to report an anticipated change in place of residence at least 48 hours before the change occurs reflects the existing requirement in section 20(1)(a) of the principal Act. The requirement to report an anticipated change in the details of any child who resides in the same place of residence and of the child’s principal caregiver at least 48 hours before the change occurs is new.
New section 20(4) provides for when exceptional circumstances make it impracticable for a registrable offender to report anticipated changes in relevant personal information within the required period.
New section 20A requires a registrable offender to report any change to relevant personal information relating to telecommunications and internet use no more than 48 hours after the change occurs (as required by new section 16(1)(p) to (t)). This requirement is new.
New section 20B requires a registrable offender to report any other change to relevant personal information (that is, a change not specified in new section 20(1) or 20A(1)) no more than 72 hours after the change occurs. This reflects the existing requirement in section 20(1)(b) of the principal Act.
New sections 20 to 20B also provide for an exception if a change to a registrable offender’s relevant personal information occurs while the registrable offender is outside New Zealand. The registrable offender must report the change to the Commissioner no more than 72 hours after they arrive back in the country. This is a change from the existing requirement in section 20(4) of the principal Act, which requires a registrable offender to report any change within 72 hours after the registrable offender has entered New Zealand and remained for 7 or more consecutive days.
New section 20C is to the same effect as section 20(5) of the principal Act. It applies if a registrable offender’s relevant personal information changes while they are in custody for more than 7 days and overrides new sections 20 to 20B. The registrable offender must report any change to their relevant personal information to the Commissioner no more than 72 hours after ceasing to be in custody.
New sections 21 and 21A retain the substance of existing section 21 of the principal Act.
New section 21 applies to a registrable offender who intends to travel for more than 48 hours within New Zealand. The registrable offender must report the intended travel at least 48 hours before travelling. This reflects the existing requirement in section 21(2) of the principal Act. New section 21(3)(c) and (d) introduces new reporting obligations if any child will, or is likely to, travel with the registrable offender or be present at any address reported under new section 21(3)(a).
New section 21A applies to a registrable offender who intends to leave New Zealand for more than 48 hours. The registrable offender must report the intended travel at least 7 days before travelling outside New Zealand. This is a change from the existing requirement in section 21(4) of the principal Act, which requires a registrable offender to report intended travel at least 48 hours before travelling.
New section 21A also introduces new reporting obligations. These are additional to the obligations added to section 21 of the principal Act by section 4 of the Child Protection (Child Sex Offender Government Agency Registration) (Overseas Travel Reporting) Amendment Act 2024. A registrable offender who does not intend to return to New Zealand is now required to report to the Commissioner—
the name of each country that they intend to enter and remain in for more than 48 hours (new section 21A(3)(b)):
entry and departure dates for each of those countries and each address they intend to stay at (new section 21A(3)(c)):
the date they intend to arrive in their new country of residence (new section 21A(3)(e)(iii)).
New section 22 is to the same effect as sections 22(1) and (2) and 23(3) of the principal Act, which specify when a registrable offender must report a change in intended travel. Under new section 22, the registrable offender must report the change as soon as practicable after deciding to make the change and, if the change to be reported is that the registrable offender has decided not to leave New Zealand, no more than 72 hours after the decision. Unlike section 22(1) of the principal Act, the requirement applies regardless of whether the registrable offender has already travelled away from their registered residential address.
New section 23 retains the substance of section 23(1) and (2) of the principal Act with the following 2 changes:
a registrable offender must report their return to New Zealand from overseas to the Commissioner within 72 hours after entering the country. This is a change from the existing requirement in section 23(2) of the principal Act, which requires a registrable offender to report any change within 72 hours after the registrable offender has entered New Zealand and remained for 7 or more consecutive days:
the requirement for a registrable offender to present their passport upon return to the Commissioner is removed. The Commissioner may instead require a registrable offender to transmit a copy of each of the offender’s passports or provide each passport (or a copy of each passport) in any manner prescribed by regulations made under new section 55 (see clause 41).
Clause 17 replaces section 25 of the principal Act with new sections 25 and 25A.
New section 25 retains the substance of section 25(1) to (3) of the principal Act. It specifies how reports about changes in a registrable offender’s relevant personal information are to be made. Most reports are to be made in a manner permitted by the Commissioner or prescribed by the regulations made under new section 55 (see clause 41). However, certain reports must be made either in person or in writing. New section 25 makes the following changes to the substance of section 25(1) to (3):
a report of a change of address, about intended travel outside New Zealand, or about a return to New Zealand no longer needs to be made in person (new section 25(3)):
reports about changes in information about nationality and citizenship must now be made in writing (new section 25(5)):
a report may now be received by either a constable or an authorised person, where previously certain in-person reports could be received only by a constable (new section 25(7)).
New section 25A retains the substance of section 25(4) and (5) of the principal Act. It enables a nominated person to make a report on behalf of a registrable offender who has a disability that makes reporting in accordance with new section 25 impossible or impracticable.
Clause 18 replaces section 27 of the principal Act. New section 27 is intended to improve the process for recording and acknowledging a report about a change in a registrable offender’s relevant personal information. The improvements include the following:
simplifying what information must be included in the acknowledgement (new section 27(3)):
requiring, rather than enabling, the Commissioner to ask the registrable offender to specify how they would prefer an acknowledgement to be provided (new section 27(4)).
Clause 19 amends section 28 of the principal Act. The effect of the amendment to section 28(3) is that a registrable offender making a report in person about a change in their relevant personal information must now provide any valid New Zealand refugee travel document or certificate of identity they possess, in addition to each valid passport.
Clause 22 repeals section 32 of the principal Act, which is about what information obtained under the principal Act may be stored on a Police information recording system. The substance of section 32 is reinserted as new sections 51B and 51C (see clause 39). New sections 51 to 51C gather together the provisions in the principal Act relating to the administration of the register.
Clause 25 amends section 36 of the principal Act. The amendment makes it clear that a registrable offender’s reporting obligations are suspended while they generally reside in a country other than New Zealand.
Subpart 4—New Part 2A heading and associated subpart headings inserted and subpart 3 of Part 2 (access to register and information sharing) replaced
Clause 26 inserts a new Part 2A heading to create new Part 2A in the principal Act. New Part 2A will contain the following existing and new provisions:
new subpart 1, comprising existing sections 41 to 47 of the principal Act as amended by clauses 28 to 34:
new subpart 2, comprising existing sections 48 to 50 of the principal Act as amended by clauses 36 and 37:
new subpart 3, comprising new sections 51 to 51C (see clauses 38 and 39):
subpart 4, comprising existing subpart 4 of Part 2 of the principal Act (sections 52, 53 (as amended by clause 40), and 54).
Clause 37 repeals section 49(7) and (8) of the principal Act, which relates to the administration of the register. Section 49(7) and (8) is reinserted into new sections 51A and 51C (see clause 39). New sections 51 to 51C gather together the provisions in the principal Act relating to the administration of the register.
Clause 37 also repeals section 49(4) of the principal Act. The effect of this repeal is that there is no limit on the time period within which a person may apply to the Commissioner to review a decision—
to place a person on the register; or
about the length of the person’s reporting period.
Clause 39 replaces section 51 of the principal Act with new sections 51 to 51C, which together constitute subpart 3 of new Part 2A.
New subpart 3 gathers together the existing provisions in the principal Act (sections 11, 32, and 49(7) and (8)) that relate to administering the register and storing information on a Police information recording system. The provisions of the principal Act are reinserted as follows:
new section 51 is based on section 11:
new section 51A is based on section 49(8):
new section 51B is based on section 32(1) and (2):
new section 51C is based on sections 32(3) and 49(7).
In addition, new section 51C places a new requirement on the Commissioner to ensure certain information about a person is removed from the register and from any Police information recording system if the person’s appeal to the District Court under section 50(2) is successful.
Section 51 of the principal Act excludes liability for acts or omissions done in good faith in the administration or execution of the principal Act. The substance of section 51 is reinserted as new section 55B (see clause 41).
Part 2Amendments to Part 3 and schedules and minor amendments
Subpart 1—Amendments to Part 3
Clause 41 replaces section 55 of the principal Act with new sections 55 to 55B.
New section 55, which contains a general regulation-making power, has been redrafted to reflect current standard drafting practice.
New section 55A relocates a notice-making power that is currently in section 43, definition of specified agency, paragraph (g). New section 55A makes it clear that a notice made under it is secondary legislation.
New section 55B is based on section 51 of the principal Act. Section 51 excludes liability for acts or omissions done in good faith in the administration or execution of the principal Act. The wording used in new section 55B aligns with section 104 of the Public Service Act 2020, which provides immunity in civil proceedings for public service chief executives and public service employees for good-faith actions or omissions when carrying out or intending to carry out their responsibilities or when performing or exercising or intending to perform or exercise their functions, duties, or powers.
Subpart 2—Amendments to schedules and minor amendments
Clause 42 inserts new Part 3, containing transitional, savings, and related provisions that relate to this Bill, into Schedule 1 of the principal Act. New Part 3 provides that the amendments in the Bill apply to registrable offenders on or after commencement, including those registrable offenders who were sentenced for a qualifying offence before the Bill commenced. However, because the Bill changes some existing reporting requirements for registrable offenders and introduces new reporting requirements, new Part 3 makes specific provision for how those reporting requirements apply on and around commencement.
Clause 43 inserts the following 5 new class 1 offences into clause 1 of Schedule 2 of the principal Act:
an offence against section 216H of the Crimes Act 1961 (prohibition on making intimate visual recording), if the subject of the visual recording is under 16 years of age:
an offence against section 390 of the Customs and Excise Act 2018 (knowingly importing or exporting objectionable publications), if the subject or a subject of the publication is under 16 years of age and the publication deals with sex:
an offence against any of the following provisions of the Prostitution Reform Act 2003:
section 20 (causing, assisting, facilitating, or encouraging a person under 18 years of age to provide commercial sexual services to any person), if the victim is under 16 years of age:
section 21 (receiving a payment if a person knows or ought reasonably to know that it is derived, directly or indirectly, from commercial sexual services provided by a person under 18 years of age), if the victim is under 16 years of age:
section 22(1) (entering into a contract or arrangement under which a person under 18 years of age provides commercial sexual services), if the victim is under 16 years of age.
Clause 43 also inserts the following 2 new class 3 offences into clause 3 of Schedule 2 of the principal Act:
an offence against section 98AA of the Crimes Act 1961 (dealing in people under 18 for sexual exploitation, removal of body parts, or engagement in forced labour), if the victim is under 16 years of age and subject to sexual exploitation:
an offence against section 22(2) of the Prostitution Reform Act 2003 (receiving commercial sexual services from a person under 18 years of age), if the victim is under 16 years of age.
Amendments relating to 2 or more provisions in the principal Act
Standardising references to information
The Bill makes a number of amendments to the principal Act to clarify the classes of information currently referred to in the principal Act.
Clauses 28, 29, and 31 to 34 amend sections 41, 42, and 44 to 47 of the principal Act respectively to replace varying references to information with the term register information, which the Bill defines to mean all the information contained in the register (see clause 5). The types of information contained in the register are listed in section 10 of the principal Act, which is amended by clause 8 of the Bill. The term register information is also used in new section 51B (see clause 39).
Clause 30 amends section 43 of the principal Act to change references to personal information to references to information. This is to avoid any suggestion that section 43 permits only personal information, as that term is defined in section 7(1) of the Privacy Act 2020, to be disclosed.
Clause 36 inserts new section 48(6), which defines the term reportable information, which is already used in section 48, to mean (for the purposes of section 48) information reported by the registrable offender under subpart 2 of Part 2 of the principal Act. This class of information includes relevant personal information and travel plans reported by the registrable offender as well as copies of any documents provided by the registrable offender.
Removing references to consecutive days
The principal Act refers in several places to time periods that are counted in consecutive days. The Bill amends those references to remove the word consecutive. Those amendments are intended to—
align the references with references to time periods in the remainder of the Act; and
reflect the approach generally taken in the New Zealand statute book that a specified time period has its natural meaning unless otherwise specified (for example, specifying that a day is a working day as defined in section 13 of the Legislation Act 2019), provided that a clear starting point is specified (see section 54 of the Legislation Act 2019).
The amendments are as follows:
removing the word consecutive in sections 13 and 20(4) and (5) of the principal Act (see clause 10, which amends section 13, and clause 15, which replaces section 20):
replacing the following sections (see clause 15) to change the reporting requirement from within 72 hours after entering and remaining in New Zealand for 7 consecutive days to no more than 72 hours after the registrable offender enters New Zealand:
section 20(4) of the principal Act, which is replaced with new section 20(3):
section 23(2), which is replaced with new section 23(2).
Improving signposts in principal Act
Clauses 11, 13, 15, 27, 35, 38, and 41 replace subpart headings or cross-headings or insert new subpart headings or cross-headings in the principal Act. The amendments are intended to make the principal Act more accessible to readers.
Clause 26 inserts a new Part 2A heading in the principal Act. The effect of this amendment is to create a new Part that deals with administering and managing the register and with associated matters.
Clause 35 inserts a new subpart heading in the principal Act. The effect of the new heading is to organise sections 48 to 50 into subpart 2 of new Part 2A, which specifies when and how a registrable offender may ask the Commissioner to provide reportable information (as defined in new section 48(6)) or to review certain decisions.
Minor amendments
Amendments for purposes of clarity and consistency
The following clauses make minor amendments to various sections of the principal Act for the purposes of improving clarity and consistency and updating and aligning wording:
clause 12 makes minor amendments to section 17 of the principal Act for the purposes of clarity and aligning wording within the principal Act, and to incorporate the new defined term residence class visa:
clause 20 replaces section 29 of the principal Act with new section 29 for the purposes of clarity:
clause 21 makes a minor amendment to section 30 of the principal Act for the purposes of clarity:
clause 23 makes a minor amendment to section 33 of the principal Act for the purposes of aligning wording within the principal Act:
clause 24 amends section 34 of the principal Act to incorporate the new defined term residence class visa:
clause 28(1) makes minor amendments to section 41 of the principal Act for the purposes of clarity:
clause 29 replaces section 42 of the principal Act to make minor amendments for the purposes of clarity:
clause 40 makes a minor amendment to section 53 of the principal Act for the purposes of clarity.
Updating references to gender
Clause 44 makes minor amendments to the principal Act to update references to gender. The amendments are set out in Schedule 2.
Consequential amendment
Clause 16 replaces section 24(3) of the principal Act as a consequence of the replacement of section 25 of the principal Act by clause 17.

3 Principal Act

a person whom a court has, in respect of a conviction for a qualifying offence,—
(i)
sentenced to imprisonment; or
(ii)
sentenced to a non-custodial sentence and made subject to a registration order; or
(b)
a corresponding registrable offender who—
(i)
resides in New Zealand; or
(ii)
holds or has applied for a residence class visa and has been granted entry permission to New Zealand.
(2)
However, a person is not a registrable offender if, at the time the person committed the qualifying offence, the person was under the age of 18 years.
(3)
A person ceases to be a registrable offender if, in respect of each qualifying offence that makes the person a registrable offender for the purposes of this Act,—
(a)
the conviction in respect of each of those qualifying offences is quashed or set aside by a court; or
(b)
the sentence in respect of each of those qualifying offences is reduced or altered so that the person would not have fallen within the definition of registrable offender in subsection (1) had the amended sentence been the original sentence; or
(c)
the registration order in respect of each of those qualifying offences is set aside by a court.
(4)
For the purposes of this section, it is irrelevant whether a person may lodge, or has lodged, an appeal in respect of a conviction or in respect of a sentence or order.

details of any internet service, computer system or device, and any other storage device used, or intended to be used, by the registrable offender, including—

the name of any internet service provider; and

the identifying details of any computer system or device capable of accessing the internet; and
(iii)
the identifying details of any computer system or device capable of enabling another computer system or device to access the internet (for example, a modem or a router):
(s)
details of any username for any online account used, or intended to be used, by the registrable offender, including, but not limited to, the following:
(i)
an online social network or platform to connect, communicate, or broadcast with others:
(ii)
an online gaming account:
(iii)
an online storage account:
(iv)
a service used to obscure internet activity or to direct network traffic:
(t)
details of any website domain owned or website administered, or intended to be owned or administered, by the registrable offender.

In this section, computer system—

means—

2 or more interconnected computers; or
(iii)
any communication links between computers or to remote terminals or any other device; or
(iv)
2 or more interconnected computers combined with any communication links between computers or to remote terminals or any other device; and
(b)
includes any part of the items described in paragraph (a) and all related input, output, processing, storage, software, communication facilities, and stored data.

Obligations to report travel plans
21 Travel plans within New Zealand to be reported
(1)
This section applies if a registrable offender intends to—
(a)
travel away from their place of residence (as defined in subsection (5)) for more than 48 hours; and
(b)
remain within New Zealand.
(2)
The registrable offender must report the intended travel to the Commissioner at least 48 hours before travelling away from their place of residence.
(3)
The registrable offender must report the following details to the Commissioner:
(a)
each address at which the registrable offender intends to stay:
(b)
the dates on which the registrable offender intends to stay at each of those addresses:
(c)
whether any child will or is likely to travel with the registrable offender and, if so,—
(i)
the name, sex, and date of birth of the child; and
(ii)
the name and contact details of the child’s principal caregiver:
(d)
if any child will be or is likely to be present with the registrable offender at any of those addresses and, if so,—
(i)
the sex of the child; and
(ii)
the age of the child or, if the registrable offender does not know the child’s actual age, the approximate age of the child:
(e)
if the registrable offender intends to return to their place of residence, the date on which they intend to return.
(4)
If exceptional circumstances arise making it impracticable for the registrable offender to make the report at least 48 hours before travelling, it is sufficient compliance with this section if the registrable offender reports the required information to the Commissioner—
(a)
as soon as practicable in the circumstances; and
(b)
before travelling.
(5)
In this section, travel away from their place of residence, in relation to a registrable offender, includes travel between different places of residence where the registrable offender resides.

21A Travel plans outside New Zealand to be reported
(1)
This section applies if a registrable offender intends to leave New Zealand for more than 48 hours.
(2)
The registrable offender must report the intended travel to the Commissioner at least 7 days before leaving New Zealand.
(3)
The registrable offender must report the following details to the Commissioner:
(a)
the date on which the registrable offender intends to leave New Zealand; and
(b)
the name of each country that the registrable offender intends to enter and remain in for more than 48 hours; and
(c)
for each of those countries,—
(i)
the dates on which the registrable offender intends to enter and leave the country; and
(ii)
each address at which the registrable offender intends to stay; and
(d)
if the registrable offender intends to return to New Zealand, the date on which the offender intends to enter New Zealand; and
(e)
if the registrable offender does not intend to return to New Zealand,—
(i)
a statement of that intention; and
(ii)
the name of the country that the registrable offender intends to generally reside in after leaving New Zealand; and
(iii)
the date on which the registrable offender intends to enter that country.
(4)
If exceptional circumstances arise making it impracticable for the registrable offender to make the report at least 7 days before leaving New Zealand, it is sufficient compliance with this section if the registrable offender reports the required information to the Commissioner—
(a)
as soon as practicable in the circumstances; and
(b)
before leaving New Zealand.

22 Change of travel plans to be reported
(1)
This section applies if a registrable offender decides to change any details reported to the Commissioner under section 21 or 21A.
(2)
The registrable offender must report the changed details to the Commissioner—
(a)
if the change to be reported is that the registrable offender has decided not to leave New Zealand, as soon as practicable after making the decision and no more than 72 hours after making the decision; or
(b)
for any other change, as soon as practicable after making the decision.

23 Return to New Zealand to be reported
(1)
This section applies to a registrable offender who—
(a)
leaves New Zealand; and
(b)
later re-enters New Zealand.
(2)
The registrable offender must report their return to New Zealand to the Commissioner no more than 72 hours after re-entering New Zealand (excluding any period spent in custody).
(3)
The Commissioner may require the registrable offender, for inspection and copying,—
(a)
to transmit a copy of each passport used by the registrable offender electronically to—
(i)
the Commissioner; or
(ii)
any other address prescribed by the regulations; or
(b)
to provide each of those passports, or a copy of each of those passports, in any other manner prescribed by the regulations.

(i)
the Commissioner; or
(ii)
any other address prescribed by the regulations; or

Who may receive report
(7)
A report made under this section or section 25A may be received by a constable or an authorised person.

25A How registrable offender with disability may make report
(1)
This section applies to a registrable offender who has a disability that makes it impossible or impracticable for the registrable offender to make a report in the manner required in section 25.
(2)
A nominated person may make the report (so far as is reasonably possible) on the registrable offender’s behalf.
(3)
A report made by the nominated person on the registrable offender’s behalf must be made—
(a)
by both the registrable offender and the nominated person attending in person; or
(b)
in another manner (including by phone or by email or other form of electronic transmission) permitted by the Commissioner or prescribed by the regulations, either generally or in a particular case.
(4)
In this section, nominated person means a person who—
(a)
is—
(i)
the registrable offender’s parent, guardian, or carer; or
(ii)
an adult 18 years of age or over; and
(b)
is chosen by the registrable offender; and
(c)
is approved by the Commissioner.

Information stored on Police information recording system
51B Police may store information obtained or taken under subpart 2 of Part 2
(1)
Information obtained or taken by the Police under subpart 2 of Part 2, including identifying particulars, may be entered, recorded, and stored on a Police information recording system.
(2)
Information recorded on any Police information recording system is not register information for the purposes of this Act.
Removing information from register and Police information recording system
51C When information must be removed from register and Police information recording system
(1)
This section applies if—
(a)
the Commissioner, under section 49(6)(b), revokes a decision to place a person on the register; or
(b)
the District Court, in determining an appeal brought under section 50(2), sets aside a review decision to place a person on the register.
(2)
The Commissioner must ensure that the information specified in subsection (3) is removed from—
(a)
the register; and
(b)
any Police information recording system in which it is entered, recorded, or stored in accordance with section 51B(1).
(3)
The specified information is—
(a)
information reported in respect of the person under subpart 2 of Part 2; and
(b)
copies of documents obtained under subpart 2 of Part 2; and
(c)
fingerprints, fingerscans, or photographs of the person taken and retained under subpart 2 of Part 2.

(1)

55A Minister may identify public sector agency as specified agency or officer
(1)
The Minister may, by notice, identify a public sector agency as a specified agency or officer for the purposes of this Act.
(2)
Before making a notice under subsection (1), the Minister must consult with the Privacy Commissioner.
(3)
In this section, public sector agency has the meaning given in section 7(1) of the Privacy Act 2020.
(4)
A notice under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
Exclusion of liability
55B Exclusion of liability
A person is immune from liability in civil proceedings for good-faith actions or omissions when—
(a)
carrying out or intending to carry out their responsibilities under this Act; or
(b)
performing or exercising or intending to perform or exercise their functions, duties, or powers under this Act.

17 Interpretation of this Part
In this Part,—
amendment Act means the Child Protection (Child Sex Offender Government Agency Registration) Amendment Act 2024
commencement means the commencement of the amendment Act
pre-existing registrable offender means a person to whom paragraph (a) or (b) of the definition of specified registrable offender applies
specified registrable offender means a person—
Offending before 14 October 2016
(a)
to whom clause 1 or 5 applies in respect of a qualifying offence, or a corresponding offence in a foreign jurisdiction, committed before 14 October 2016; or
Offending on or after 14 October 2016 and before commencement
(b)
who is a registrable offender, or a corresponding registrable offender, in respect of a qualifying offence, or a corresponding offence in a foreign jurisdiction, committed on or after 14 October 2016 and before commencement; or
Offending on or after commencement
(c)
who is a registrable offender, or a corresponding registrable offender, in respect of a qualifying offence, or a corresponding offence in a foreign jurisdiction, committed on or after commencement.
Subpart 1—How Act applies to, and transitional reporting arrangements for, specified registrable offenders
18 Application of Act as amended by amendment Act
On or after commencement, this Act as amended by the amendment Act applies to specified registrable offenders.
19 Pre-existing registrable offenders must report additional relevant personal information
(1)
A pre-existing registrable offender must report to the Commissioner no more than 30 days after commencement.
(2)
The report to the Commissioner must be—
(a)
sent by post; or
(b)
transmitted by email or other form of electronic transmission; or
(c)
made by phone.
(3)
The report must specify any relevant personal information that—
(a)
is required to be reported under the Act (as amended by the amendment Act); but
(b)
was not required to be reported under the Act immediately before commencement.
(4)
However, if a pre-existing registrable offender is due to make a periodic report within 30 days of commencement, the offender—
(a)
must make the periodic report; and
(b)
may report the information specified in subclause (3) to the Commissioner at the same time as making the periodic report.
(5)
This clause applies despite section 34.
(6)
This clause does not limit the reporting obligations under this Act as amended by the amendment Act (see clause 18) of—
(a)
a pre-existing registrable offender after 30 days after commencement; or
(b)
a specified registrable offender who is not a pre-existing registrable offender.
20 Clauses 18, 19, and 21 to 27 override any inconsistent other law
(1)
The following clauses have effect despite any other law if, or to the extent that, the other law is inconsistent with them:
(a)
clause 18:
(b)
clause 19:
(c)
clauses 21 to 27.
(2)
In particular, any other law, for the purposes of subclause (1), includes any law in all or any of the following:
(a)
section 6(1) and (2) of the Sentencing Act 2002:
(b)
sections 25(g) and 26(2) of the New Zealand Bill of Rights Act 1990:
(c)
D (SC 31/2019) v New Zealand Police [2021] NZSC 2.
Subpart 2—Transitional and savings provisions relating to changes in reporting requirements
21 When sections 20 to 20C apply on and after commencement
(1)
Sections 20 to 20C apply only to a change in a specified registrable offender’s relevant personal information that occurs on or after commencement.
(2)
Subclause (1) is subject to clause 22.
(3)
Section 20 as in force immediately before commencement continues to apply to a change in a pre-existing registrable offender’s relevant personal information that occurs before commencement.
22 Transitional arrangement for changes required to be reported under section 20(2) and (3)
(1)
This clause applies to a pre-existing registrable offender if,—
(a)
before commencement, the offender reported their relevant personal information under section 16(1)(e) or (f) as in force immediately before commencement; and
(b)
in the period starting on commencement and ending 48 hours later,—
(i)
the offender is in New Zealand; and
(ii)
the relevant personal information described in paragraph (a) changes.
(2)
Despite section 20(2), the offender must report the change to the Commissioner no more than 72 hours after the change occurs.
23 When section 21 applies on and after commencement
(1)
Section 21 applies only to an intent to travel that a specified registrable offender forms on or after commencement to—
(a)
travel away from their place of residence (as defined in section 21(5)) for more than 48 hours; and
(b)
remain within New Zealand.
(2)
Section 21(2), (5), and (6) as in force immediately before commencement continues to apply to an intent to travel that a pre-existing registrable offender forms before commencement.
24 When section 21A applies on and after commencement
(1)
Section 21A applies only to an intent that a specified registrable offender forms on or after commencement to leave New Zealand for more than 48 hours.
(2)
Subclause (1) is subject to clause 25.
(3)
Section 21(4) and (5) as in force immediately before commencement continues to apply to an intent to travel that a pre-existing registrable offender forms before commencement.
25 Transitional arrangement for changes required to be reported under sections 21A(2) and (3) and 25(2)
(1)
This clause applies to a specified registrable offender if, during the period starting on commencement and ending 7 days after commencement, the offender forms the intent to leave New Zealand for more than 48 hours.
(2)
Despite section 21A(2), the offender must report the intended travel to the Commissioner at least 48 hours before travelling.
(3)
Despite sections 21A(3) and 25(2), the offender must attend in person to report the following details to the Commissioner:
(a)
the date on which the offender intends to travel out of New Zealand:
(b)
if the offender intends to return to New Zealand,—
(i)
the date on which the offender intends to return; and
(ii)
the name of each country that the offender intends to travel to, and remain in for more than 48 hours; and
(iii)
for each of those countries, the following details:
(A)
each address at which the offender intends to stay; and
(B)
the date on which the offender intends to arrive in the country; and
(C)
the date on which the offender intends to travel out of the country; and
(c)
if the offender does not intend to return to New Zealand,—
(i)
a statement of that intention; and
(ii)
the name of the country that the offender intends to generally reside in after leaving New Zealand.
26 When section 22 applies on and after commencement
(1)
Section 22 applies only to a decision that a specified registrable offender makes on or after commencement to change any details reported to the Commissioner under section 21 or 21A.
(2)
Section 22 as in force immediately before commencement continues to apply to a decision that a pre-existing registrable offender makes before commencement to change any details reported to the Commissioner under section 21(2) or (4), as in force immediately before commencement.
27 When section 23 applies on and after commencement
(1)
Section 23 applies only to an instance of travel that a specified registrable offender undertakes on or after commencement in which the offender—
(a)
leaves New Zealand; and
(b)
later re-enters New Zealand.
(2)
Section 23 as in force immediately before commencement continues to apply to an instance of travel undertaken by a pre-existing registrable offender in which the offender leaves New Zealand before commencement.
Subpart 3—Appointment as authorised person continues
28 Appointment as authorised person continues
(1)
A person who, immediately before commencement, is an authorised person appointed under section 11(3) must, on and after commencement, be treated as a person appointed as an authorised person under section 51(3).
(2)
Subclause (1) does not limit the Commissioner’s powers under section 45 of the Legislation Act 2019.
