An Act to amend “The Customs Duties Act 1858”
in relation to Military Supplies.
Preamble.
Whereas by the “Constitution Act”
it is enacted that it shall not be lawful for the General Assembly of New Zealand to levy any duty upon articles imported for the supply of Her Majesty’s Land or Sea Forces And whereas it is desirable to provide for the payment of Drawback on the duties paid on certain articles consumed by Her Majesty’s Land and Sea Forces although such articles may not have been imported for the supply of such Forces within the meaning of the “Constitution Act”
And also to provide for the issue out of Bond of any such articles not specially imported or entered for general consumption but which may be required for the supply aforesaid And whereas by the direction of the Commissioner of Customs such articles have in certain cases been issued out of Bond free of duty and in certain other cases Drawback of the duties leviable on such articles has been allowed and it is expedient to indemnify the said Comissioner of Customs and the other Officers of Customs concerned in such transactions
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows:
I Short Title.
The Short Title of this Act shall be the “Military Supplies Customs Act 1862.”
II Governor may prescribe Regulations for issue &c., of articles.
It shall be lawful for the Governor by Order in Council to be published in the Government Gazette to declare what articles may be issued free of duty for the supply of Her Majesty’s Sea and Land Forces and to prescribe regulations for the issue of such articles out of Bond or for the payment of Drawback of any duty which may have been levied and paid on such articles and also to prescribe the manner in which the due and proper consumption, of such article may be certified to the Commissioner of Customs and such regulations from time to time to revoke or alter.
III Officers of Customs may issue out of Bond or allow Drawback on articles.
Subject to such regulations it shall be lawful for the Commissioner and other Officers of Customs to issue such articles out of Bond and to repay or allow Drawback thereon if the duty has been paid.
IV Indemnity for past allowances.
The Commissioner of Customs and all other Officers of Customs at any time before the passing of this Act concerned in the allowance of Drawback of Duties of Customs on articles consumed by Her Majesty’s Land and Sea Forces or in the issue of such articles free of duty are indemnified against all actions and proceedings on account thereof.
