An Act to amend “The Supreme Court Judges Act 1858.”
Preamble.
WHEREAS by an Act of the General Assembly of New Zealand the Short Title of which is “The Supreme Court Judges Act 1858”
it is enacted that the Supreme Court of New Zealand shall consist of one Judge to be appointed in the name and on behalf of Her Majesty who shall be called the Chief Justice and of such other Judges as His Excellency in the name and on behalf of Her Majesty shall from time to time appoint And whereas certain powers and duties are vested in and conferred on the Chief Justice of the said Court and certain powers and duties are vested in and conferred on the person acting as or appointed or authorized to execute the duties of the Chief Justice of the said Court and it is expedient that provision should be made for the performance of such duties and the exercise of such powers as are vested in or conferred on the Chief Justice of the said Court during any vacancy in the said office or during any absence from the Colony of the person holding such office
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
I Short Title.
The Short Title of this Act shall be “The Supreme Court Judges Act 1866.”
II During vacancy in office of Chief Justice or absence of Chief Justice First Puisne Judge to be deemed principal judicial officer and to execute duties and powers of Chief Justice.
During any vacancy in the office of Chief Justice of the Supreme Court of New Zealand and during any absence from the Colony of the person for the time being holding such office the Senior or First Puisne Judge of the said Court shall be and be deemed to be the Principal Judicial Officer of the Colony and shall be authorized to act as Chief Justice of the said Court and to execute the duties of the said office and to exercise all such powers as by any Act of the Imperial Parliament or the General Assembly are conferred on the Chief Justice of such Court.
