An Act to apply a sum of Money out of the Ordinary Revenue to the service of the year ending the 30th day of June 1867.
Preamble
WHEREAS it appears by Messages from His Excellency Sir George Grey Knight Commander of the Most Honorable Order of the Bath Governor and Commander-in-Chief in and over Her Majesty’s Colony of New Zealand and its Dependencies and Vice Admiral thereof and by the Estimates accompanying the same that the sums hereinafter mentioned are required to defray certain expenses of the Government of this Colony and of the Public Service thereof and for other purposes for the year ending on the thirtieth day of June one thousand eight hundred and sixty-seven
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
I Short Title.
The Short Title of this Act shall be “The Appropriation Act 1866.”
II Appropriations for current year. Public Domains and Buildings £7,228 13s. Public Departments £40,655. Departments of Law and Justice £69,801 14s. Postal Departments £196,656 0s. 8d. Customs Departments £48,655 2s. Native Departments £29,986 15s. 10d. Miscellaneous Special and Temporary objects £47,517 15s. 4d. Colonial Defence £159,022 19s. 3d.
From and out of the Ordinary Revenue of the Colony and the moneys authorized to be raised by “The Treasury Bills Act 1866”
there shall and may be issued and applied towards making good the supply granted to Her Majesty for the service of the year ending on the thirtieth day of June one thousand eight hundred and sixty-seven in addition to the sums mentioned in “The Civil List Act”
and other Acts the sum of Five hundred and ninety-nine thousand five hundred and twenty-four pounds and one penny (£599,524 0s. 1d.) to be appropriated towards or for the purposes hereinafter expressed that is to say—Any sum or sums of money not exceeding Seven thousand two hundred and twenty-eight pounds thirteen shillings (£7228 13s.) to defray the salaries contingencies and expenses of Public Domains and Buildings in the manner hereinafter expressed that is to say—for Government Domains One thousand one hundred and seventy-eight pounds thirteen shillings (£1178 13s.) for Government Houses Five hundred pounds (£500) for General Assembly Buildings Five thousand pounds (£5000) for Colonial Museum One hundred and fifty pounds (£150) for Clerk of Public Works Four hundred pounds (£400) And any sum or sums of money not exceeding Forty thousand six hundred and fifty-five pounds (£40,655) to defray the salaries contingencies and expenses of Public Departments in the manner hereinafter expressed that is to say—for Governor’s establishment One thousand six hundred pounds (£1600) for Legislative departments Thirteen thousand one hundred and sixty-seven pounds (£13,167) for Executive departments Eight thousand eight hundred and ninety-three pounds (£8893) for Stamp office Three thousand pounds (£3000) for Printing department Four thousand three hundred and forty pounds (£4340) for Geological Survey Three thousand eight hundred and fifty pounds (£3850) and for Provincial charges Treasury departments Two thousand six hundred and fifty-five pounds (£2655) for Electoral departments Three thousand one hundred and fifty pounds (£3150) And any sum or sums of money not exceeding Sixty-nine thousand eight hundred and one pound fourteen shillings (£69,801 14s.) to defray the salaries contingencies and expenses of departments of Law and Justice in the manner hereinafter expressed that is to say—for General charges Three thousand eight hundred pounds (£3800) for Provincial charges Supreme Courts Eight thousand three hundred and forty-nine pounds ten shillings (£8349 10s.) for District Courts Four thousand five hundred pounds (£4500) for Resident Magistrates’ Courts Thirty thousand five hundred and ninety-seven pounds four shillings (£30,597 4s.) for Petty Sessions Courts Four hundred pounds (£400) for Criminal prosecutions Ten thousand pounds (£10,000) for Coroners Two thousand and fifty pounds (£2050) for Electoral Seven hundred and twenty-five pounds (£725) for Land and Deeds Registry Nine thousand three hundred and eighty pounds (£9380) And any sum or sums of money not exceeding One hundred and ninety-six thousand six hundred and fifty-six pounds and eight pence (£196,656 0s. 8d.) to defray the salaries contingencies and expenses of Postal departments in the manner hereinafter expressed that is to say—for General charges General Post Office Three thousand two hundred and fifteen pounds (£3215) conveyance of Mails by sea Sixty-five thousand three hundred pounds (£65,300) Telegraph departments Forty-nine thousand eight hundred and fifty-five pounds four shillings (£49,855 4s.) Militia Volunteers and Armed Constabulary Seventy thousand pounds (£70,000) Colonial Forces existing liabilities Thirty-seven thousand two hundred and two pounds nine shillings and three pence (£37,202 9s. 3d.) charges on account of final settlement of Military Settlers Twenty-five thousand pounds (£25,000) surveys and administration of confiscated lands by way of advance Twenty-five thousand pounds (£25,000).
III Payments may be made monthly on account of Surplus Revenue.
During the year ending the thirtieth day of June one thousand eight hundred and sixty-seven there shall be issued and applied monthly out of the ordinary revenue of the Colony to each of the several Provinces of New Zealand a sum equal to three-eighths of the gross Customs Revenue collected within such Province and the sums so paid shall be deemed to be payments on account of the surplus ordinary revenue payable to such Province under “The Surplus Revenues Act 1858”
and if the total payments to any Province under the authority hereby given shall exceed the amount due to such Province for the year ending the thirtieth day of June one thousand eight hundred and sixty-seven the account of such Province shall in the month of July one thousand eight hundred and sixty-seven be debited by the Colonial Treasurer with such excess.
IV Colonial Treasurer indemnified against unauthorised expenditure to 30th June 1866 amounting to £61.140 9s. 10d. Such expenditure how to be charged.
And whereas the actual expenditure of the General Government exceeded the sums authorized by the “Appropriation Act 1863”
and “The Appropriation Act 1865”
respectively by the sum of Sixty-one thousand one hundred and forty pounds nine shillings and ten pence (£61,140 9s. 10d.) And whereas the said expenditure was reasonable and necessary therefore the several Colonial Treasurers and all persons whatsoever shall be and are hereby indemnified for and in respect of any orders or directions which they or either of them may have given or made or caused to be given or made for the expenditure of the said sum of Sixty-one thousand one hundred and forty pounds nine shillings and ten pence (£61,140 9s. 10d.) or any portion or portions thereof and for and in respect of all payments of the said several sums and every part thereof made or caused to be made by them or any of them for the purposes set forth in the Estimates of such Expenditure and it is hereby provided that the said expenditure shall be deemed and taken to have been expenditure authorized by “The Appropriation Act 1865”
and charged as such.
V Treasurer’s authority to pay.
The Treasurer of New Zealand shall issue and pay the said several sums hereby appropriated to such persons for the purposes hereinbefore mentioned upon such days and in such proportions as the Governor may by any warrant to be signed by him from time to time order and direct and the payment so to be made shall be charged upon and payable out of such revenue as aforesaid.
VI Credit to be allowed to Treasurer for disbursements.
The said Treasurer shall in his accounts from time to time be allowed credit for any sum of money paid by him in pursuance of any warrant issued by virtue of this Act and the receipt of the person to whom the same shall be so paid shall be a full and valid discharge to the said Treasurer in passing his said accounts for any such sum as shall be therein mentioned.
