An Act to amend “The Juries Act, 1868.”
Preamble.
WHEREAS it is expedient to amend “The Juries Act, 1868,”
in certain particulars:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Juries Act 1868 Amendment Act, 1874.”
2 Persons claiming to be excused from serving on a jury on the ground of being active members of a Volunteer Fire Brigade to be discharged.
If any person summoned under the said Act to appear and serve as a juror shall produce to the Judge of the Court at which he shall have been so summoned to appear, a certificate under the hand of a Fire Inspector, or of the Captain or other principal officer of a Volunteer Fire Brigade, to the effect that such person is an active member of a Volunteer Fire Brigade, and has regularly attended the meetings of such brigade for practice or drill for a period of not less than twelve months before the sitting of the Court at which he has been summoned to appear as aforesaid, and has otherwise observed the rules or regulations of the said brigade in respect to attendance at practice or drill and at fires: And if such person shall claim to be excused or discharged from attending and serving as a juror by reason of his being an active member of a Volunteer Fire Brigade, the Judge of the Court at which such person shall have been so summoned to appear shall thereupon excuse and discharge such person from further attendance at that sitting of the Court, and in respect of the summons requiring him to appear and serve as a juror.
3 Penalty for giving or making use of certificate containing statement not true in fact.
If any Fire Inspector or any Captain or other principal officer of a Volunteer Fire Brigade shall knowingly give any such certificate as aforesaid containing any false statement of any matter of fact, such person shall forfeit a sum of not exceeding twenty pounds or less than five pounds: And if any person shall claim to be excused or discharged from serving as a juror on the production of such a certificate as aforesaid which shall contain any false statement of fact, such person shall forfeit a sum not exceeding fifty pounds or less than ten pounds.
