An Act to remove doubts as to the Tolls to be collected and taken at Toll Gates in the Province of Wellington.
Preamble.
WHEREAS doubts exist as to the tolls authorized to be collected and taken under the provisions of certain Acts of the Superintendent and Provincial Council of the Province of Wellington respectively, passed in the years one thousand eight hundred and seventy-two and one thousand eight hundred and seventy-three, the first of which is intituled “An Act to amend the Acts of the Superintendent and Provincial Council relating to Toll Gates,”
and the second of which is intituled “An Act to further amend the Acts of the Superintendent and Provincial Council relating to Toll Gates:”
And whereas it is expedient to put an end to such doubts:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Wellington Toll Gates Act, 1875.”
2 The tolls in Schedule to be deemed to be and to have been the authorized tolls from 12th August, 1875, under the Provincial Acts of 1872 and 1873.
The tolls in the Schedule to this Act shall be deemed to be the tolls authorized to be collected and taken under the provisions of the said Acts of the Superintendent and Provincial Council of the Province of Wellington. No person shall be entitled to recover from the said Superintendent or from the Provincial Government of the said province or from any collector of tolls any sum or sums of money which may have been paid by any such person for tolls taken or alleged to hare been taken under the authority of the said Acts or either of them, between the first day of November, one thousand eight hundred and seventy-three, and the date of the passing of this Act.

This Schedule shall he read as if the words mare, gelding, ass, mule, bull, cow, or calf, were inserted after the word horse throughout:
Provided that no toll shall be taken on any vehicle or horse repassing or returning on the same day, except vehicles carrying passengers in the usual business of passenger carriers.
Every vehicle having the tires of all its wheels of a breadth of not less than five inches, and so formed that a breadth of not less than five inches comes in contact with the ground on a firm cart road, and every horse drawing such vehicle, shall be chargeable with tolls at one-half the rate which would otherwise be charged thereon under this Schedule.
